【摘要】：我國的文物行政執(zhí)法工作起步時間不長,在文物行政執(zhí)法過程中還面臨著各種各樣的難題。本文根據(jù)筆者多年的文物行政執(zhí)法工作實踐經(jīng)驗,結(jié)合工作當(dāng)中遇到的實際情況,以西安市的實際情況為例,討論了當(dāng)前文物行政執(zhí)法工作當(dāng)中面臨的執(zhí)法工作問題和諸如執(zhí)法現(xiàn)場出土文物安全、大遺址保護、田野文物安全、文物市場管理等多方面的文物安全問題。 執(zhí)法現(xiàn)場出土文物安全方面,本文主要分析了基建工地施工過程中造成文物破壞的幾種不同情況以及這些情況產(chǎn)生的原因,并且提出了執(zhí)法現(xiàn)場的出土文物應(yīng)當(dāng)參照考古發(fā)掘現(xiàn)場對出土文物的臨時保護措施加以保護的創(chuàng)新性觀點。 在大遺址安全方面,本文主要分析了當(dāng)前在當(dāng)前城市化迅速發(fā)展的背景下,城市建設(shè)和人居活動對城市及其周邊的大遺址造成的威脅,并深刻分析了原因,最終論證了文物行政執(zhí)法工作在大遺址安全保護工作中的地位和作用。 田野文物安全方面,本文以西安地區(qū)明代秦王陵陵前露天石刻面臨的問題為例,在加強田野文物的人防與技防方面提出了保護要求。 最后,本文討論了文物犯罪與文物市場管理之間存在的必然的因果關(guān)系,在打擊文物違法犯罪和加強文物市場管理方面提出了自己的觀點和看法。 本文將文物行政執(zhí)法工作和文物安全保護相結(jié)合,為實際工作當(dāng)中解決這方面的問題提供了一定的思考和借鑒。
[Abstract]:The administrative law enforcement of cultural relics in our country is not a long time, in the process of administrative enforcement of cultural relics is also facing a variety of difficulties. Based on the author's practical experience in administrative law enforcement of cultural relics for many years and the actual situation encountered in the work, this paper takes the actual situation in Xi'an as an example. This paper discusses the problems of law enforcement in the current administrative law enforcement of cultural relics and the safety of cultural relics in many aspects such as the safety of excavated cultural relics at the scene of law enforcement, the protection of large sites, the safety of cultural relics in the field, and the market management of cultural relics. With regard to the safety of cultural relics unearthed at the site of law enforcement, this paper mainly analyzes several different situations that caused the destruction of cultural relics during the construction of infrastructure construction sites and the causes of these conditions. It also puts forward the innovative viewpoint that the unearthed cultural relics at the law enforcement site should refer to the archaeological excavation site to protect the unearthed cultural relics by temporary protection measures. In the aspect of great site safety, this paper mainly analyzes the threat of urban construction and human settlement activities to the city and its surrounding sites under the background of the current rapid development of urbanization, and deeply analyzes the reasons. Finally, it demonstrates the status and function of administrative law enforcement of cultural relics in the work of safety protection of large sites. In the aspect of field cultural relic safety, taking the problems faced by the open-air stone carvings in front of the tomb of Qin Wang Mausoleum in Xi'an area as an example, the author puts forward the protection requirements in strengthening the civil air defense and technical protection of the field cultural relics. Finally, this paper discusses the inevitable causality between the crime of cultural relics and the market management of cultural relics, and puts forward its own viewpoints and opinions on cracking down on the illegal crime of cultural relics and strengthening the management of the market of cultural relics. This paper combines the administrative law enforcement work of cultural relics with the safety protection of cultural relics, and provides some thinking and reference for solving the problems in practical work.
