政府采購(gòu)中的行政救濟(jì)研究

【摘要】:近年來(lái),政府采購(gòu)作為世界各國(guó)管理經(jīng)濟(jì)和社會(huì)生活的一種重要手段,因其帶來(lái)的巨大的經(jīng)濟(jì)和社會(huì)效益而在我國(guó)得到了蓬勃的發(fā)展。伴隨著政府采購(gòu)取得的諸多佳績(jī)而來(lái)的是貪污腐敗、權(quán)力尋租、違規(guī)審批等不良行為,侵害供應(yīng)商的權(quán)利的現(xiàn)象比比皆是。本被形象地比喻為“陽(yáng)光工程”的政府采購(gòu),實(shí)務(wù)中卻被烏云籠罩著。建立一套供應(yīng)商權(quán)利救濟(jì)制度,有利于增強(qiáng)供應(yīng)商對(duì)政府采購(gòu)的信心,激發(fā)供應(yīng)商主動(dòng)參與政府采購(gòu)的興趣,也是我國(guó)政府采購(gòu)融入國(guó)際化的客觀需要。 與普通的采購(gòu)不同,政府采購(gòu)兼具民事和行政雙重性質(zhì),各國(guó)傳統(tǒng)的救濟(jì)模式采用籠統(tǒng)的單一模式,,即私法或公法模式。自從二階段理論廣泛應(yīng)用到各國(guó)立法實(shí)踐中,政府采購(gòu)的性質(zhì)才有了新的認(rèn)識(shí)。該理論將政府采購(gòu)合同的簽訂作為分界點(diǎn),分為采購(gòu)合同授予階段和采購(gòu)合同履行階段。政府采購(gòu)合同授予階段,采購(gòu)主體的行政性質(zhì)明顯,擁有公權(quán)力作為其后盾,采用二階段理論的國(guó)家都認(rèn)同該階段適用公法救濟(jì);至于采購(gòu)合同履行階段,各國(guó)對(duì)適用私法救濟(jì)還是公法救濟(jì)模式仍存爭(zhēng)議。本文從行政法學(xué)視角對(duì)政府采購(gòu)救濟(jì)制度進(jìn)行研究,從控權(quán)監(jiān)督的角度構(gòu)建適合我國(guó)國(guó)情的政府采購(gòu)行政救濟(jì)制度模式。 本文第一部分是引言,包括選題背景、研究目的及研究意義;第二部分研究政府采購(gòu)中行政救濟(jì)的基本理論,包括政府采購(gòu)主體的明確、特征,行政救濟(jì)的含義、政府采購(gòu)中行政救濟(jì)的產(chǎn)生、試用階段、范圍等內(nèi)容;第三部分國(guó)外政府采購(gòu)中的救濟(jì)制度對(duì)比研究,主要介紹國(guó)際經(jīng)濟(jì)組織、日本、英國(guó)、美國(guó)等的政府采購(gòu)救濟(jì)制度,同時(shí)還對(duì)我國(guó)政府采購(gòu)行政救濟(jì)制度的立法現(xiàn)狀進(jìn)行分析;第四部分通過(guò)對(duì)比檢視和反思我國(guó)政府采購(gòu)中行政救濟(jì)制度存在的問(wèn)題;第五部分,完善我國(guó)政府采購(gòu)中行政救濟(jì)制度提出可行性的對(duì)策。
[Abstract]:In recent years, government procurement, as an important means of managing economic and social life in the world, has been booming in China because of its enormous economic and social benefits. Along with the good achievements of government procurement, corruption, power rent-seeking, illegal examination and approval and other bad behavior, infringement of the rights of suppliers can be found everywhere. Government procurement, which was likened to "Sunshine Project", was shrouded in dark clouds in practice. The establishment of a supplier right relief system is conducive to enhancing the suppliers' confidence in government procurement and stimulating the interest of suppliers to participate in government procurement actively. It is also the objective need for our government procurement to be integrated into the internationalization. Different from ordinary procurement, government procurement has both civil and administrative nature, and the traditional relief mode of various countries adopts a general single model, namely private law or public law. Since the two-stage theory has been widely used in the legislative practice of various countries, the nature of government procurement has gained a new understanding. The theory regards the signing of government procurement contract as the dividing point, which is divided into procurement contract award stage and procurement contract performance stage. In the awarding stage of government procurement contract, the administrative nature of the procurement subject is obvious, and the public power is the backing of the procurement subject. The countries that adopt the two-stage theory agree that public law relief is applicable in this stage; as for the stage of the performance of the procurement contract, There are still disputes about whether private law relief or public law relief mode is applied in various countries. This paper studies the system of government procurement relief from the perspective of administrative law, and constructs the administrative relief system model of government procurement suitable for our country's national conditions from the angle of control and supervision. The first part of this paper is the introduction, including the background of the topic, the purpose and significance of the research; the second part studies the basic theory of administrative relief in government procurement, including the clear, characteristics, the meaning of administrative relief. The third part is the comparative study of the relief system in foreign government procurement, mainly introduces the international economic organizations, Japan, the United Kingdom, the United States and other government procurement relief system. At the same time, it also analyzes the legislative status of our government procurement administrative relief system; the fourth part through comparative examination and reflection of our government procurement administrative relief system problems; part five, To perfect the administrative relief system in the government procurement of our country puts forward the feasible countermeasure.
