【摘要】：自上世紀(jì)中期,隨著醫(yī)學(xué)的迅猛發(fā)展,醫(yī)療技術(shù)已不再成為器官移植發(fā)展的重大阻礙,人體器官移植無疑給需求者們帶來了巨大的福祉和希望,與此同時,人體器官移植也引發(fā)了法律、倫理、公平等一系列社會問題。本文闡述了當(dāng)前我國人體器官移植管理所存在的問題及其原因,提出了人體器官移植管理應(yīng)遵循的原則及優(yōu)化我國人體器官移植管理的對策,具體分為以下幾個內(nèi)容： (1)人體器官移植管理理論基礎(chǔ)構(gòu)建。從人體器官移植管理的相關(guān)概念、我國現(xiàn)行人體器官移植的管理政策、人體器官移植管理的公共性及其社會價值三個方面來構(gòu)建人體器官移植管理的理論框架。 (2)當(dāng)前我國人體器官移植管理所存在的問題及其成因。從人體器官移植過程管理的混亂、人體器官移植管理法律規(guī)范問題和人體器官移植管理引發(fā)的公平性問題三個維度進(jìn)行闡述,并分析問題的成因,為提出我國人體器官移植管理的對策建議提供現(xiàn)實(shí)基礎(chǔ)。 (3)人體器官移植管理應(yīng)遵循的原則。主要講述人體器官移植管理應(yīng)遵循尊重生命原則和禁止器官買賣原則、知情同意原則和保密原則和有利原則和公平原則,為后文優(yōu)化我國人體器官移植管理的對策提供原則指導(dǎo)。 (4)我國人體器官移植管理的對策。從國外人體器官移植管理模式經(jīng)驗(yàn)借鑒、健全人體器官移植管理的分配體系、完善人體器官移植管理的法制體系和建立人體器官移植管理的監(jiān)督體系四個方面給出我國人體器官移植管理具體的對策。
[Abstract]:Since the middle of the last century, with the rapid development of medicine, medical technology has no longer become a major obstacle to the development of organ transplantation. Human organ transplantation has also caused a series of social problems, such as law, ethics, fairness and so on. This paper expounds the problems existing in the management of human organ transplantation in our country and its causes, and puts forward the principles to be followed in the management of human organ transplantation and the countermeasures to optimize the management of human organ transplantation in China. It is divided into the following contents: (1) the theoretical foundation of human organ transplantation management. From the relevant concepts of human organ transplantation management, the current management policy of human organ transplantation in China, The public nature and social value of human organ transplantation management are three aspects to construct the theoretical framework of human organ transplantation management. (2) the existing problems and causes of human organ transplantation management in China. From the three dimensions of confusion in the management of human organ transplantation process, the legal norm of human organ transplantation management and the fairness problem caused by human organ transplantation management, the causes of the problems are analyzed. In order to provide practical basis for the management of human organ transplantation in China. (3) the principles to be followed in the management of human organ transplantation. Focusing on the principle that the management of human organ transplantation should be guided by the principles of respect for life and prohibition of organ trade, informed consent and confidentiality, and favourable and equitable principles, It provides the principle guidance for optimizing the management of human organ transplantation in our country. (4) the countermeasure of human organ transplantation management in our country. To improve the distribution system of human organ transplantation management from the experience of foreign human organ transplantation management model, Four aspects of perfecting the legal system of human organ transplantation management and establishing the supervision system of human organ transplantation management are put forward. The concrete countermeasures of human organ transplantation management in China are given.
