【摘要】：土地管制權(quán)的來(lái)源與土地利用的物理特性及土地所有制度有密切關(guān)系,該權(quán)力的來(lái)源決定了土地管制權(quán)力在本質(zhì)上與公共利益有不可分割的關(guān)系,因此,土地管制權(quán)的理論基礎(chǔ)就是公共利益。土地管制權(quán)中的公共利益具有自身的特點(diǎn),這些特點(diǎn)決定了公共利益可以對(duì)土地管制權(quán)力進(jìn)行一定的規(guī)制。規(guī)制的核心要素是判斷土地管制中公共利益標(biāo)準(zhǔn)以及保證公益機(jī)制。
[Abstract]:The source of land control right is closely related to the physical characteristics of land use and the system of land ownership. The source of this power determines that the power of land control is intrinsically related to the public interest. The theoretical basis of land control right is public interest. The public interest in the land control right has its own characteristics, which determines that the public interest can regulate the land control power to a certain extent. The core element of regulation is to judge the standard of public interest in land control and to ensure public benefit mechanism.
