【摘要】：健康環(huán)境權(quán)來源于20世紀(jì)60年代以來的環(huán)境運(yùn)動(dòng),并為目前國際人權(quán)法的司法實(shí)踐所認(rèn)可。盡管以生命健康權(quán)為代表的既有人權(quán)保障機(jī)制對(duì)于環(huán)境保護(hù)而言是一個(gè)有效的方法,但畢竟不能對(duì)環(huán)境利益予以整全性的保護(hù),不符合現(xiàn)代環(huán)境保護(hù)的需要,也不適宜作為證成"環(huán)境權(quán)"的例證。實(shí)證分析表明,拉丁美洲各國法院在多起案件中加以直接運(yùn)用的"健康環(huán)境權(quán)"并不意味著是對(duì)"環(huán)境權(quán)"的直接適用;美國各州憲法中相關(guān)條款的司法適用也表明,"健康環(huán)境權(quán)"與"環(huán)境權(quán)"在司法適用上具有截然不同的法律效力。"健康環(huán)境權(quán)"是作為人權(quán)的健康權(quán)在環(huán)境保護(hù)領(lǐng)域的適用,而不是"環(huán)境權(quán)"的組成部分。
[Abstract]:The right to a healthy environment derives from the environmental movement since the 1960s and is recognized by the current judicial practice of international human rights law. Although the existing human rights protection mechanism, represented by the right to life and health, is an effective method for environmental protection, it cannot protect environmental interests in an integrated manner and does not meet the needs of modern environmental protection. It is also unsuitable to be an example of "environmental right". The empirical analysis shows that the "right to a healthy environment", which is directly applied by the courts of various Latin American countries in many cases, does not mean the direct application of the "right to the environment"; The judicial application of the relevant provisions in the American constitutions also shows that the "right to a healthy environment" and the "right to the environment" have distinct legal effects in judicial application. " The right to a healthy environment is an application of the right to health as a human right in the field of environmental protection, not an integral part of the right to the environment.
