【摘要】：近年來，信訪制度出現(xiàn)了很多問題，對(duì)信訪制度進(jìn)行改革，已經(jīng)成為一個(gè)全社會(huì)的共識(shí)。本文的主體一共由四部分構(gòu)成，第一部分首先從表現(xiàn)形式，原因，，負(fù)面影響等方面介紹了信訪制度存在的矛盾，接著對(duì)學(xué)者之間改革的爭議做了簡要的闡述；第二部分首先介紹了部分國家與信訪制度有相似功能的民愿處理機(jī)制，主要有瑞典監(jiān)察專員制度和德國的申訴委員會(huì)制度，接著闡述了這些處理機(jī)制帶給我們的啟示；第三部分是本文的重點(diǎn)部分，首先從正當(dāng)性和現(xiàn)實(shí)性的角度論證了信訪存在的必要性，接著從人大信訪委員會(huì)設(shè)立的原因、基本原則以及具體的制度構(gòu)想等幾個(gè)方面詳細(xì)的闡述了人大信訪委員會(huì)的設(shè)立，最后再闡述了設(shè)立人大信訪委員會(huì)的相關(guān)的配套制度。第四部分主要是人大信訪委員會(huì)與檢察監(jiān)督、審計(jì)監(jiān)督以及行政訴訟的銜接問題。
[Abstract]:In recent years, there have been many problems in the petition system. It has become a consensus of the whole society to reform the petition system. The main body of this paper is composed of four parts. The first part introduces the contradictions in the system of letter and visit from the aspects of form, cause and negative influence, and then makes a brief exposition on the controversy of the reform among scholars. The second part first introduces some countries and the system of letters and visits with similar functions of the processing mechanism of the people's wishes, mainly the Swedish Ombudsman system and Germany's Complaints Committee system, and then elaborated on these mechanisms to us inspiration; The third part is the key part of this paper, first from the point of view of legitimacy and reality to demonstrate the necessity of the existence of letters and visits, and then from the reasons for the establishment of the people's Congress Committee of Letters and visits. The basic principle and the concrete system conception and so on elaborated in detail the establishment of the National people's Congress letter and visit Committee, and finally elaborated the relevant supporting system of setting up the people's Congress letter and visit Committee. The fourth part is mainly about the connection between NPC petition committee and procuratorial supervision, audit supervision and administrative litigation.
