【摘要】：地方立法前評(píng)估機(jī)制是提高地方立法質(zhì)量的一條有效路徑。建立良好的地方立法前評(píng)估制度能夠有效遏制過度立法,降低立法成本,避免不良法律的出臺(tái)。目前,我國(guó)已有許多省份和城市在制定法律法規(guī)之前,通過問卷、座談會(huì)等方式對(duì)其可行性、合理性等方面問題施行調(diào)查研究,以提高立法的質(zhì)量。固然已有部分省市制訂了立法前評(píng)估的相關(guān)規(guī)定,但這些規(guī)定尚不夠具體完善,在實(shí)踐過程中難以發(fā)揮應(yīng)有的效用,使得這一制度并未產(chǎn)生預(yù)期的效果。為解決由于此項(xiàng)評(píng)估機(jī)制不完善而產(chǎn)生的困擾,本文首先對(duì)地方立法前評(píng)估機(jī)制的內(nèi)涵以及立法評(píng)估活動(dòng)在國(guó)內(nèi)外的產(chǎn)生與發(fā)展施行簡(jiǎn)要介紹,其次對(duì)地方立法前評(píng)估機(jī)制分別從主體、對(duì)象、內(nèi)容、方法、程序等方面施行了探究,并整理總結(jié)了國(guó)內(nèi)外立法評(píng)估的實(shí)踐,旨在對(duì)地方立法前評(píng)估的理論基礎(chǔ)及實(shí)踐情況施行簡(jiǎn)要介紹,并通過個(gè)案研究、經(jīng)驗(yàn)總結(jié)和文獻(xiàn)研究,發(fā)現(xiàn)并找出目前理論見解的不足之處以及在實(shí)踐過程中存在的具體問題,并整合國(guó)內(nèi)外的具體經(jīng)驗(yàn),結(jié)合相關(guān)的理論創(chuàng)新,重新建立更為系統(tǒng)、完善的地方立法前評(píng)估機(jī)制,以使其能適應(yīng)社會(huì)的發(fā)展,適應(yīng)我國(guó)的民族文化背景,增強(qiáng)和改進(jìn)地方立法工作,提升立法質(zhì)量。
[Abstract]:The pre-evaluation mechanism of local legislation is an effective way to improve the quality of local legislation. The establishment of a good local pre-legislative evaluation system can effectively curb excessive legislation, reduce the cost of legislation, and avoid the introduction of bad laws. At present, many provinces and cities in China have investigated and studied the feasibility and rationality of the laws and regulations by means of questionnaires and symposiums before making laws and regulations in order to improve the quality of legislation. Although some provinces and cities have formulated the relevant provisions of pre-legislative evaluation, these provisions are not specific and perfect enough, and it is difficult to play their due role in the practice process, which makes this system have not produced the expected effect. In order to solve the problems caused by the imperfection of the evaluation mechanism, this paper first introduces the connotation of the local pre-legislation evaluation mechanism and the development of the legislative evaluation activities at home and abroad. Secondly, this paper probes into the local pre-legislative evaluation mechanism from the aspects of subject, object, content, method, procedure and so on, and summarizes the practice of domestic and foreign legislative evaluation. The purpose of this paper is to introduce briefly the theoretical basis and practice of local pre-legislative evaluation, and through case study, experience summarization and literature study, to find out the shortcomings of current theoretical opinions and the concrete problems existing in the process of practice. And integrate the specific experience at home and abroad, combined with relevant theoretical innovation, re-establish a more systematic and perfect local legislative pre-evaluation mechanism, so that it can adapt to the development of society, adapt to the national cultural background of our country. Strengthen and improve the work of local legislation, improve the quality of legislation.
