【摘要】：虐待動(dòng)物的嚴(yán)峻現(xiàn)狀,促使中國(guó)社會(huì)開(kāi)始關(guān)注和思考動(dòng)物保護(hù)問(wèn)題,也推動(dòng)了動(dòng)物福利立法進(jìn)程。2009年《中華人民共和國(guó)動(dòng)物保護(hù)法》和2010年《中華人民共和國(guó)反虐待動(dòng)物法》兩個(gè)"專(zhuān)家建議稿"的出臺(tái)曾在中國(guó)社會(huì)上引起很大的反響,此后中國(guó)的動(dòng)物福利立法卻并沒(méi)有取得突破性進(jìn)展。在新修訂的《野生動(dòng)物保護(hù)法》中,各界寄予厚望能寫(xiě)入"動(dòng)物福利"條款,最終也未能如愿。其根源在于,動(dòng)物福利的理念在中國(guó)并沒(méi)有深入人心,公眾擔(dān)心推動(dòng)動(dòng)物福利立法會(huì)與"人的福利""社會(huì)福利"沖突,認(rèn)為在中國(guó)搞動(dòng)物福利立法尚不具備條件,"動(dòng)物福利"是"奢侈品"等。厘清以上問(wèn)題,是進(jìn)一步推動(dòng)中國(guó)動(dòng)物福利立法的關(guān)鍵所在。
[Abstract]:The severe situation of animal abuse has prompted Chinese society to begin to pay attention to and think about animal protection. It has also promoted the process of animal welfare legislation. The publication of the two "expert proposals" of the 2009 "Animal Protection Law of the people's Republic of China" and the "2010 Anti-Animal abuse Law of the people's Republic of China" has aroused great repercussions in Chinese society. Since then, China's animal welfare legislation has not made a breakthrough. In the newly revised Wildlife Protection Act, the expectations were high and failed. The root cause is that the concept of animal welfare is not deeply popular in China, and the public is worried about the conflict between the Legislative Council on Animal Welfare and the "Human Welfare" and "Social Welfare". The author thinks that there are no conditions for establishing animal welfare legislation in China, and animal welfare is a luxury. To clarify the above issues is the key to further promote China's animal welfare legislation.
