【摘要】：農(nóng)地合作社作為農(nóng)民專業(yè)合作社的主要表現(xiàn)形式之一,是在家庭聯(lián)產(chǎn)承包經(jīng)營制度自身改革和發(fā)展的實(shí)踐過程中創(chuàng)新出來的土地利用方式。它是對農(nóng)村土地流轉(zhuǎn)模式的創(chuàng)新和發(fā)展,是在“明確所有權(quán)、穩(wěn)定承包權(quán)、搞活經(jīng)營權(quán)”的前提下,通過股份合作的形式集中優(yōu)化農(nóng)地資源,實(shí)現(xiàn)農(nóng)村土地的市場化、規(guī)模化經(jīng)營。但由于理論基礎(chǔ)研究的薄弱以及法律規(guī)范的滯后,使得農(nóng)地合作社在發(fā)展過程中出現(xiàn)的一系列問題得不到及時(shí)解決,嚴(yán)重影響農(nóng)地合作社的自治和發(fā)展。筆者將農(nóng)地合作社置身于現(xiàn)代農(nóng)業(yè)建設(shè)市場化進(jìn)程的大環(huán)境下,將股權(quán)配置和收益分配等運(yùn)行模式問題從制度中剝離開來,化繁為簡,從農(nóng)地合作社的法律地位出發(fā),對內(nèi)部治理機(jī)制和外部政府監(jiān)管進(jìn)行分析,找出其發(fā)展面臨的根源問題,從而就為農(nóng)地合作社提供穩(wěn)定的治理環(huán)境提出相關(guān)的對策和建議。文章正文分為五個部分:第一部分:問題的提出。通過對湖南省郴州市農(nóng)地合作社的案例研究,肯定政府扶持下的農(nóng)地合作社發(fā)展現(xiàn)狀,從中梳理現(xiàn)今大部分農(nóng)地合作社都存在的自治問題。第二部分:農(nóng)地合作社的法律地位分析�？季哭r(nóng)地合作社法律地位的立法現(xiàn)狀,明確農(nóng)地合作尷尬的法律地位,從而引出下文。第三部分:農(nóng)地合作社的內(nèi)部治理。通過對農(nóng)地合作社的內(nèi)部組織結(jié)構(gòu)的梳理,對其內(nèi)部治理困境進(jìn)行分析研究,并提出完善建議。第四部分:我國農(nóng)地合作社的外部治理。列舉我國農(nóng)地合作社政府監(jiān)管過程中出現(xiàn)的問題以及相關(guān)法律的空白,提出建議與對策,從而完善我國農(nóng)地合作社外部監(jiān)管體系。
[Abstract]:As one of the main manifestations of farmers' specialized cooperatives, agricultural land cooperatives are the land use mode which is innovated in the process of reform and development of the household contract management system. It is the innovation and development of the mode of rural land circulation. On the premise of "clear ownership, stable contract right, enlivening the management right", it concentrates and optimizes agricultural land resources through the form of stock cooperation, and realizes the marketization of rural land. To operate on a large scale. However, due to the weakness of theoretical basic research and the lag of legal norms, a series of problems in the development of agricultural land cooperatives can not be solved in time, which seriously affects the autonomy and development of agricultural land cooperatives. The author puts the agricultural land cooperative in the great environment of the marketization process of modern agricultural construction, separates the operation mode problems such as the allocation of shares and the distribution of income from the system, simplifies it, and proceeds from the legal status of the agricultural land cooperative. This paper analyzes the internal governance mechanism and external government supervision, finds out the root problems facing its development, and puts forward relevant countermeasures and suggestions on providing a stable governance environment for agricultural land cooperatives. The text of the article is divided into five parts: the first part: put forward the problem. Through the case study of agricultural land cooperatives in Chenzhou, Hunan Province, this paper confirms the present situation of agricultural land cooperatives supported by the government, and combs the autonomy problems existing in most agricultural land cooperatives. The second part: the analysis of the legal status of agricultural land cooperatives. The legislative status of farmland cooperatives is studied, and the awkward legal status of agricultural land cooperation is clarified, which leads to the following. The third part: the internal governance of agricultural land cooperatives. Through combing the internal organization structure of agricultural land cooperative, this paper analyzes and studies its internal governance dilemma, and puts forward some suggestions to improve it. The fourth part: the external governance of agricultural land cooperatives in China. This paper enumerates the problems in the process of government supervision of agricultural land cooperatives in China and the blank of relevant laws, and puts forward some suggestions and countermeasures to perfect the external supervision system of agricultural land cooperatives in China.
