【摘要】：從行政法的視角來看,機(jī)動(dòng)車限行常態(tài)化規(guī)定爭議背后所體現(xiàn)的核心問題是,如何對現(xiàn)代城市管理中涉及行政專業(yè)化與復(fù)雜利益沖突的行政立法進(jìn)行法律約束。我國現(xiàn)有的行政立法制度無法提供有效的機(jī)制來協(xié)調(diào)各種利益沖突,行政立法權(quán)也欠缺合法性審查機(jī)制的約束。改善大氣質(zhì)量和交通通行效率的行政規(guī)制及其立法要具有合法性并被社會(huì)所接受,必須明確其法律根據(jù),引入"成本-效益"分析方法,改善意見聽取制度,加強(qiáng)立法和司法監(jiān)督機(jī)制,同時(shí)完善行政問責(zé)制。
[Abstract]:From the perspective of administrative law, the core problem behind the dispute on the regularization of motor vehicle restrictions is how to restrict the administrative legislation in modern urban management which involves administrative specialization and complex conflicts of interest. The existing administrative legislation system of our country can not provide effective mechanism to coordinate all kinds of conflicts of interest, and the administrative legislative power also lacks the restriction of legality examination mechanism. In order to have legitimacy and be accepted by the society, the administrative regulation and legislation to improve air quality and traffic efficiency must make clear its legal basis, introduce the method of "cost-benefit" analysis, and improve the system of hearing opinions. Strengthen the legislative and judicial supervision mechanism and improve the administrative accountability system at the same time.
