【摘要】：道路交通事故認定作為道路交通管理的重要組成部分,在整個事故處理中起著舉足輕重的作用,對交通事故當事人的權利義務產(chǎn)生重大影響。交通事故認定書作為道路交通事故認定的結果,是當事人承擔民事責任、行政責任和刑事責任等法律責任的關鍵性證據(jù)。因此,確保道路交通事故認定的有效法律救濟,也就成為保證交通事故公正處理的關鍵所在。道路交通事故認定的法律救濟有兩種方式:一是道路交通事故認定復核程序;二是人民法院對交通事故認定書的證據(jù)審查,但是由于復核程序常常被規(guī)避執(zhí)行,交通事故認定書又超出了證據(jù)的作用范疇;加之,受統(tǒng)一裁判尺度規(guī)則的影響,現(xiàn)行道路交通事故認定的法律救濟模式形同虛設,無法保障交通事故當事人對道路交通事故認定的合理訴求。究其原因,這與交通事故認定書的證據(jù)種類、道路交通事故認定的性質、行政執(zhí)法與司法裁判因果關系認定等方面存在的問題息息相關。解決道路交通事故認定的法律救濟的癥結在于重新審視道路交通事故認定的性質,只有將道路交通事故認定納入行政訴訟范圍,才能破解當前道路交通事故認定法律救濟模式存在的種種問題,使交管部門的道路交通事故認定裁量權依法納入法治的軌道�！斑t到的正義非正義”,在將道路交通事故認定納入行政訴訟范圍的同時,通過構建民事附帶行政訴訟程序制度、引入行政終局裁決機制,注意保護受害人的合法權益,防止權利的濫用,為完善道路交通事故認定的法律救濟程序規(guī)則提供可行性建議。
[Abstract]:As an important part of road traffic management, road traffic accident identification plays an important role in the whole accident treatment, and has a significant impact on the rights and obligations of the parties involved in the traffic accident. As the result of road traffic accident identification, the traffic accident cognizance document is the key evidence of the parties' legal liability, such as civil liability, administrative liability and criminal liability. Therefore, to ensure the effective legal relief of road traffic accident is the key to ensure the fair handling of traffic accident. There are two kinds of legal remedies for road traffic accident determination: one is the review procedure for road traffic accident determination; the other is the people's court's examination of the evidence of the traffic accident confirmation document, but because the review procedure is often circumvented from execution, In addition, under the influence of the unified rules of judgment, the current legal relief model of road traffic accident identification is virtually empty. Can not protect the traffic accident parties to identify the reasonable demand for road traffic accidents. The reasons are closely related to the types of evidence, the nature of road traffic accidents, the relationship between administrative law enforcement and judicial adjudication causality, and so on. The crux of solving the problem of legal relief for road traffic accident identification lies in reexamining the nature of road traffic accident determination, and only bringing road traffic accident determination into the scope of administrative litigation, In order to solve the problems existing in the current legal relief mode of road traffic accident identification, the discretion of road traffic accident identification in traffic management department can be brought into the orbit of rule of law according to law. "late justice and injustice", while bringing road traffic accidents into the scope of administrative litigation, by establishing a system of civil incidental administrative proceedings, introducing administrative final adjudication mechanisms, and paying attention to the protection of the legal rights and interests of the victims, To prevent the abuse of rights and provide feasible suggestions for perfecting the rules of legal relief procedure for road traffic accident identification.
