【摘要】：改革開(kāi)放后,商業(yè)社會(huì)的蓬勃發(fā)展使得政府職能弱化成為必然趨勢(shì),在網(wǎng)絡(luò)普及的時(shí)代,信息化的便利化運(yùn)用與公民個(gè)人信息的不惡意搜集和不良使用并存。在我國(guó)涉及個(gè)人信息管理立法存在滯后性的背景之下,針對(duì)公民信息的立法保護(hù)顯得尤為必要。本文將在探討行政機(jī)關(guān)搜集、運(yùn)用公民個(gè)人信息的程序基礎(chǔ)之上,著重探討對(duì)于信息運(yùn)用主體的權(quán)利保護(hù)和在信息利用過(guò)程之中,公民應(yīng)當(dāng)享受的法定權(quán)利,意在通過(guò)從根本法和部門(mén)法兩個(gè)層面上,建構(gòu)公民信息保護(hù)的法律框架,發(fā)展和完善有關(guān)個(gè)人信息的立法保護(hù)。
[Abstract]:After the reform and opening up, the vigorous development of the commercial society makes the weakening of government functions become an inevitable trend. In the era of network popularization, the convenience of information technology and citizens' personal information collection and bad use coexist. Under the background of lag in the legislation of personal information management in our country, it is particularly necessary to protect civil information. On the basis of discussing the procedure of collecting and using citizens' personal information, this paper will focus on the protection of the rights of information users and the legal rights that citizens should enjoy in the process of using information. The purpose of this paper is to develop and perfect the legislative protection of personal information by constructing the legal framework of citizen information protection from the two levels of fundamental law and branch law.
