【摘要】：我國《國家賠償法》樹立了保障權(quán)利與促進國家機關(guān)依法行使職權(quán)的雙重宗旨,但在實踐中加以落實卻并非易事。本文通過對虛擬版"有人落水案"和現(xiàn)實版"單據(jù)賠償案"進行分析,認(rèn)為應(yīng)將保障受到公權(quán)侵害的公民合法權(quán)益為基本宗旨的《國家賠償法》定位于社會法,在權(quán)利救濟與責(zé)任追究上確立有別于傳統(tǒng)法律觀的觀念。
[Abstract]:The State compensation Law of our country has set up the double purposes of protecting rights and promoting the state organs to exercise their functions and powers according to law, but it is not easy to carry out them in practice. Based on the analysis of the fictitious version of "the case of a person falling into the water" and the "case of compensation for documents", this paper holds that the State compensation Law, whose basic purpose is to protect the legitimate rights and interests of citizens who have been infringed by public rights, should be positioned in the social law. The concept of right relief and responsibility investigation is different from the traditional legal view.
