新疆進(jìn)口食品安全監(jiān)管的法律問(wèn)題研究

【摘要】:近年來(lái),隨著全國(guó)食品問(wèn)題的曝光,食品安全日趨成為了人們的焦點(diǎn),,同時(shí)隨著全球經(jīng)濟(jì)一體化的進(jìn)程,在國(guó)際貿(mào)易中進(jìn)出口食品安全的問(wèn)題也越來(lái)越突顯。而作為新疆,為我國(guó)邊境線最長(zhǎng)、對(duì)外開放口岸最多的省區(qū),在我國(guó)與國(guó)際進(jìn)出口貿(mào)易來(lái)往中占據(jù)著不可磨滅的地位。在黨和國(guó)家的關(guān)懷下,新疆的經(jīng)濟(jì)發(fā)展?fàn)顩r和人民的生活水平日益提高,食品貿(mào)易也成為了打開新疆對(duì)外發(fā)展經(jīng)濟(jì)的窗口,進(jìn)口食品再給新疆人民帶來(lái);莸耐瑫r(shí),進(jìn)口食品安全問(wèn)題也日益凸顯。由于近些年來(lái),進(jìn)口食品出現(xiàn)的等等問(wèn)題,使得各國(guó)對(duì)外國(guó)進(jìn)入的食品進(jìn)行了嚴(yán)格的限制和標(biāo)準(zhǔn),造成了一定程度的貿(mào)易壁壘,阻礙了我國(guó)進(jìn)出口食品貿(mào)易的發(fā)展。做為世界上最大的發(fā)展中國(guó)家,進(jìn)出口食品貿(mào)易對(duì)我國(guó)影響深遠(yuǎn),而我國(guó)在進(jìn)出口食品安全法律方面起步較晚,很多法律、法規(guī)制度、各項(xiàng)技術(shù)標(biāo)準(zhǔn)都不夠完善,在一定程度上不能與其他國(guó)家同步,而在對(duì)進(jìn)口食品的監(jiān)管上存在很多漏洞。因此加強(qiáng)和完善我國(guó)政府對(duì)進(jìn)口食品的管制,如何擴(kuò)大新疆進(jìn)口食品市場(chǎng),規(guī)范新疆進(jìn)口食品市場(chǎng)的監(jiān)管,加強(qiáng)與內(nèi)陸地區(qū)的經(jīng)濟(jì)合作都是亟需解決的問(wèn)題。本文將從新疆進(jìn)出口食品市場(chǎng)背景出發(fā),研究新疆進(jìn)口食品市場(chǎng)發(fā)展的現(xiàn)狀和前景,從我國(guó)《食品安全法》的角度分析新疆進(jìn)口食品市場(chǎng)監(jiān)管存在的主要障礙和問(wèn)題,提出可行性建議。本文分為五章節(jié): 第一章“進(jìn)口食品安全相關(guān)理論概述”。本章首先介紹了進(jìn)口食品安全的相關(guān)概念,以及從國(guó)際社會(huì)及各國(guó)對(duì)進(jìn)口食品安全定義的界定和食品的特點(diǎn),以及食品安全的內(nèi)涵和食品安全監(jiān)管的定義。 第二章“新疆進(jìn)口食品安全狀況”。本章首先從新疆進(jìn)口食品基本狀況和經(jīng)營(yíng)進(jìn)口食品的企業(yè)資質(zhì)條件兩個(gè)方面,展開介紹新疆進(jìn)口食品市場(chǎng)的基本狀況,然后針對(duì)進(jìn)口食品不合格總體情況對(duì)進(jìn)口食品不合格狀況及其原因做了具體分析。 第三章“國(guó)家進(jìn)口食品安全立法與執(zhí)法體制狀況”。本章首先對(duì)國(guó)家進(jìn)口食品安全的立法與執(zhí)法狀況進(jìn)行了分析,闡明了我國(guó)進(jìn)口食品安全監(jiān)管法律的現(xiàn)狀。然后分析了新疆進(jìn)口食品安全執(zhí)法監(jiān)管具體問(wèn)題。 第四章“對(duì)新疆進(jìn)口食品安全監(jiān)管的對(duì)策研究”。本章通過(guò)上文對(duì)新疆進(jìn)口食品市場(chǎng)安全狀況及當(dāng)前執(zhí)法狀況的分析,對(duì)新疆進(jìn)口食品安全監(jiān)管工作提出相應(yīng)的可行性建議及對(duì)策,加強(qiáng)食品安全制度的建設(shè)。
[Abstract]:In recent years, with the exposition of food problems in China, food safety has become the focus of people. At the same time, with the process of global economic integration, the problem of food safety in international trade has become increasingly prominent. With the concern of the Party and the state, Xinjiang's economic development and people's living standards are improving day by day. Food trade has become a window for Xinjiang's foreign economic development. Imported food brings benefits to the people of Xinjiang. At the same time, the problem of imported food safety has become increasingly prominent. In recent years, problems such as imported food have caused countries to impose stringent restrictions and standards on food imported from foreign countries, resulting in a certain degree of trade barriers, hindering the development of China's import and export of food trade. Import and export food safety laws started late, many laws, regulations and systems, various technical standards are not perfect, to a certain extent can not be synchronized with other countries, but there are many loopholes in the supervision of imported food. Standardizing the supervision of Xinjiang's imported food market and strengthening the economic cooperation with inland areas are all problems that need to be solved urgently.This paper will start from the background of Xinjiang's imported and exported food market, study the present situation and Prospect of Xinjiang's imported food market development, and analyze the main problems of Xinjiang's imported food market supervision from the Perspective of China's Food Safety Law. Obstacles and problems, put forward feasible suggestions. This article is divided into five chapters:
Chapter 1 "Overview of the relevant theories of imported food safety". This chapter firstly introduces the related concepts of imported food safety, as well as the definition and characteristics of imported food safety from the international community and countries, as well as the connotation of food safety and the definition of food safety supervision.
Chapter 2 "The Situation of Imported Food Safety in Xinjiang". This chapter firstly introduces the basic situation of Xinjiang's imported food market from two aspects: the basic situation of Xinjiang's imported food and the qualifications of enterprises operating imported food. Then it makes a concrete analysis of the unqualified situation of imported food and the reasons for the unqualified situation. Analysis.
Chapter 3 "The State Import Food Safety Legislation and Law Enforcement System". Firstly, this chapter analyzes the legislation and law enforcement of national import food safety, clarifies the current situation of China's import food safety supervision law, and then analyzes the specific problems of Xinjiang's import food safety law enforcement and supervision.
Chapter IV "Research on the Countermeasures of Import Food Safety Supervision in Xinjiang". Through the above analysis of Xinjiang's import food market security situation and current law enforcement situation, this chapter puts forward corresponding feasible suggestions and Countermeasures for Xinjiang's import food safety supervision, and strengthens the construction of food safety system.
