【摘要】：實(shí)踐中警察盤查侵權(quán)的案例經(jīng)常發(fā)生,隨著權(quán)利意識(shí)的提高,人們也越來越多的關(guān)注此類案件的發(fā)生及其結(jié)果。警察擁有行使盤查權(quán)的自由裁量權(quán),但是,盤查權(quán)的不當(dāng)運(yùn)用則會(huì)對(duì)公民的人身權(quán)等合法權(quán)益造成嚴(yán)重侵犯,這不僅給違法犯罪嫌疑人和普通公眾帶來了損害,而且也嚴(yán)重?fù)p害了公安機(jī)關(guān)的執(zhí)法權(quán)威,對(duì)社會(huì)穩(wěn)定的維護(hù)以及公民合法權(quán)益的保護(hù)帶來了巨大的障礙。而如何合理規(guī)范盤查權(quán),在警察保障治安與維護(hù)社會(huì)穩(wěn)定的同時(shí),避免對(duì)公民權(quán)利的侵犯,也正是本文所關(guān)注的。本文通過對(duì)盤查權(quán)理論分析的基礎(chǔ)上,以國(guó)內(nèi)發(fā)生的典型案例為引線,分析侵權(quán)案例中所存在的違規(guī)之處,指出我國(guó)盤查權(quán)制度所面臨的尷尬現(xiàn)狀及存在的問題。通過對(duì)域外國(guó)家盤查權(quán)制度的研究和分析,總結(jié)出國(guó)外盤查權(quán)制度的優(yōu)越之處。最后通過總結(jié),提出我國(guó)盤查權(quán)改進(jìn)的思考和建議。
[Abstract]:In practice, the cases of police investigation and infringement often occur. With the improvement of awareness of rights, people pay more and more attention to the occurrence of such cases and their results. The police have the discretion to exercise the right of checking, but the improper application of the power of investigation will seriously infringe upon the legal rights and interests of citizens, such as the personal rights of citizens, which not only brings harm to the criminal suspects and the general public. It also seriously damages the law enforcement authority of public security organs and brings huge obstacles to the maintenance of social stability and the protection of citizens' legitimate rights and interests. And how to reasonably regulate the right to check, while the police to ensure public order and maintain social stability, to avoid the violation of civil rights, is also the focus of this article. Based on the theoretical analysis of the rights of inspection, this paper analyzes the irregularities in the infringement cases, and points out the embarrassing situation and the existing problems in the system of the right of inspection in our country, taking the typical cases in China as the lead. Through the research and analysis of the system of the foreign country's right of inspection, the advantages of the foreign system of the right of inspection are summarized. Finally, through the summary, puts forward our country to check the right to improve the thought and the suggestion.
