【摘要】：隨著食品貿(mào)易的全球化，，食源性疾病等食品安全問題已經(jīng)逐步成為了一個(gè)世界性問題，引起了各個(gè)國(guó)家的廣泛關(guān)注，中國(guó)作為世界新興食品進(jìn)口大國(guó)，亦應(yīng)積極制定政策保護(hù)本國(guó)食品市場(chǎng)安全，加強(qiáng)對(duì)進(jìn)口食品的監(jiān)管，提升進(jìn)口食品立法水平，參照國(guó)際慣例和國(guó)際標(biāo)準(zhǔn)，建立切實(shí)可行的進(jìn)口食品監(jiān)管體系。隨著《中華人民共和國(guó)食品安全法》的頒行，我國(guó)開始建立初具現(xiàn)代化的食品安全風(fēng)險(xiǎn)機(jī)制，然而，相較西方發(fā)達(dá)國(guó)家較為完備的安全監(jiān)管體系而言，我國(guó)對(duì)進(jìn)口食品的監(jiān)管仍處于初級(jí)水平，鮮有先進(jìn)的理念和體制創(chuàng)新，尚未形成一套完整有效的本土機(jī)制，監(jiān)管體系仍不完備，針對(duì)進(jìn)口食品監(jiān)管的研究尚處于起步階段。鑒于此，本文第二、三部分將對(duì)我國(guó)現(xiàn)行法律制度和監(jiān)管體制進(jìn)行分析，闡明我國(guó)目前立法存在的問題；在第四部分考察了歐美的相關(guān)制度架構(gòu)，以期了解國(guó)際食品安全監(jiān)管立法的現(xiàn)狀和發(fā)展態(tài)勢(shì)；在文章第五部分基于以上對(duì)現(xiàn)存立法空白和立法缺陷，以及國(guó)際先進(jìn)立法制度體系的分析，得出我國(guó)進(jìn)口食品監(jiān)管立法的完善建議。
[Abstract]:With the globalization of food trade, food safety problems such as foodborne diseases have gradually become a worldwide problem, which has aroused the widespread concern of all countries. China, as a new food importer in the world, We should also actively formulate policies to protect the safety of our food market, strengthen the supervision of imported food, raise the level of legislation on imported food, and establish a feasible regulatory system for imported food according to international practice and international standards. With the enactment of the Food Safety Law of the people's Republic of China, China has begun to establish a modern food safety risk mechanism. However, compared with the more complete safety supervision system in western developed countries, The supervision of imported food in our country is still at the primary level, few advanced ideas and system innovation, has not yet formed a complete and effective local mechanism, the regulatory system is still incomplete, and the research on the supervision of imported food is still in its infancy. In view of this, the second and third parts of this paper will analyze the current legal system and supervision system of our country, clarify the problems existing in the current legislation of our country; in the fourth part, we will examine the relevant institutional framework of Europe and the United States. In the fifth part of the article, based on the above analysis of the existing legislative gaps and shortcomings, as well as the international advanced legislative system, Get the perfect suggestion of our country import food regulation legislation.
