【摘要】：一直以來,對治安違法行為的規(guī)制主要依托治安處罰,目前這種側重事后處罰的傳統(tǒng)規(guī)制正在遭遇治理效果日益衰減的困境,其根本結癥在于被處罰人存在逃避處罰的權利性機會。新規(guī)制路徑將治安違法行為信息及逃避處罰行為信息納入國家征信系統(tǒng),這種側重事前預防的規(guī)制可對全體公民的違法行為及其逃避處罰行為產生廣泛而持久的約束效力,進而從根本上提升治安違法行為規(guī)制的社會治理效果。
[Abstract]:For a long time, the regulation of illegal behavior of public order mainly depends on the punishment of public security. At present, the traditional regulation, which emphasizes on the punishment after the fact, is encountering the dilemma that the effect of governance is decreasing day by day. The fundamental problem lies in the existence of the right opportunity for the penalized person to evade punishment. The new regulation path brings the information of public order illegal behavior and the information of evading punishment into the state credit investigation system. This regulation, which emphasizes on the prevention in advance, can have extensive and lasting binding effect on the illegal behavior of all citizens and their evasion of punishment. And then fundamentally improve the social governance effect of public order illegal behavior regulation.
