【摘要】：研究目的:歸納總結(jié)"推進(jìn)依憲修改完善《土地管理法》專題研究座談會(huì)"的重要觀點(diǎn),為《土地管理法》修改提供建議和參考。研究方法:綜述分析。研究結(jié)果:現(xiàn)行《土地管理法》存在著一定的歷史局限性,并與相關(guān)法律存在交叉和沖突;在當(dāng)前社會(huì)經(jīng)濟(jì)發(fā)展新常態(tài)下,《土地管理法》修改應(yīng)頂層設(shè)計(jì)先行,明確其立法性質(zhì)和定位,確定立法目的與任務(wù),對(duì)具體條款進(jìn)行修改和完善,并與其他相關(guān)法律協(xié)調(diào)統(tǒng)一。研究結(jié)論:《土地管理法》中的土地權(quán)利體系需要進(jìn)一步明確和完善;集體土地所有權(quán)的主體、權(quán)能、界定、行使等相關(guān)問(wèn)題需進(jìn)一步明確,防止被弱化;宅基地使用權(quán)的修改需要統(tǒng)籌兼顧、分類設(shè)計(jì),對(duì)具體環(huán)節(jié)規(guī)定進(jìn)行完善;集體經(jīng)營(yíng)性建設(shè)用地的修改需要建立利益調(diào)節(jié)機(jī)制,規(guī)范流轉(zhuǎn)環(huán)節(jié);土地征收補(bǔ)償?shù)牧⒎ㄐ薷膽?yīng)當(dāng)從立法定位、權(quán)利劃定、補(bǔ)償標(biāo)準(zhǔn)等方面建立系統(tǒng)的修改方案。
[Abstract]:The purpose of this paper is to summarize the important viewpoints of the Symposium on promoting the improvement of the Land Management Law in accordance with the Constitution, and to provide suggestions and references for the revision of the Land Management Law. Methods: review and analysis. The research results show that the present Land Management Law has some historical limitations, and there is a cross and conflict with the relevant laws, and under the new normal condition of the current social and economic development, the revision of the Land Management Law should be preceded by the top-level design. It clarifies its legislative nature and position, determines the legislative purpose and task, modifies and perfects the specific provisions, and harmonizes and unifies with other relevant laws. Research conclusion: the land right system in the Land Management Law needs to be further clarified and perfected, the subject, power, definition and exercise of collective land ownership need to be further clarified to prevent weakening. The modification of the right to use the homestead needs to be integrated, classified and designed, and the regulation of the specific links should be perfected, and the modification of the land for collective use of construction needs to establish a mechanism for regulating the interests of the land, and to standardize the circulation of the land; The legislative revision of land expropriation compensation should be systematically revised from the aspects of legislative orientation, right delineation, compensation standard and so on.
