【摘要】：城市規(guī)劃中土地利用制度的價值要求包含“公平”和“正義”兩方面內(nèi)容。具體而言,“正義”意在為公共政策提供價值導(dǎo)向和標準,“公平”則力求糾正公共決策帶來的物質(zhì)與非物質(zhì)利益分配失衡,而具體法律規(guī)范的作用是在上述理念的要求下對于城市規(guī)劃行為進行具體規(guī)制。需要依據(jù)城市規(guī)劃中土地利用的特性,對于其范疇內(nèi)“正義”的原則和標準問題進行討論;闡釋在“公平”的要求下,城市規(guī)劃需要如何平衡多種利益。研究土地利用法律如何將規(guī)劃正義中的基本原則具體化,在規(guī)劃運行過程中規(guī)范各主體的行為,并對于出現(xiàn)的不公進行糾偏和補救,對于解決我國城市規(guī)劃實踐中出現(xiàn)的問題具有重要意義。
[Abstract]:The value of land use system in urban planning includes two aspects: equity and justice. In particular, "justice" is intended to provide value orientation and standards for public policy, while "equity" seeks to correct the imbalance between material and non-material benefits resulting from public decision-making. The function of the specific legal norms is to regulate the urban planning behavior under the requirements of the above ideas. According to the characteristics of land use in urban planning, this paper discusses the principles and standards of "justice" in urban planning, and explains how urban planning needs to balance various interests under the requirement of "equity". This paper studies how to concretize the basic principles of planning justice in land use law, standardize the behavior of various subjects in the course of planning operation, and correct and remedy the injustices that appear. It is of great significance to solve the problems in the practice of urban planning in China.
