【摘要】：我國《反恐怖主義法》首次確立了基于恐怖活動和極端主義罪犯"社會危險性"的安置教育制度,這一刑后預防性監(jiān)禁制度的確立是我國懲治恐怖主義犯罪的創(chuàng)舉,也標志著我國保安處分體系的初步建立。構(gòu)建我國涉恐罪犯安置教育制度應當遵循法治原則、懲防結(jié)合原則和教育矯治原則。在制度設計上應進一步明確其適用對象,建立包括評估主體、評估方法、評估要素和評估周期在內(nèi)的社會危險性評估體系,完善安置教育的決定、實施、救濟與監(jiān)督的司法化程序和具體制度內(nèi)容。
[Abstract]:The Anti-Terrorism Law of our country established for the first time a system of placement and education based on the "social danger" of terrorist activities and extremist criminals, and the establishment of the system of preventive imprisonment after this sentence is the pioneering act of punishing the crime of terrorism in our country. It also marks the initial establishment of the system of security measures in China. In order to construct our country's education system, we should follow the principle of rule by law, the principle of combination of punishment and prevention, and the principle of education and correction. In the system design, we should further clarify its applicable object, establish a social risk assessment system including the evaluation subject, assessment methods, evaluation elements and evaluation cycle, perfect the decision of placement education, and implement it. The judicial procedure and concrete system content of relief and supervision.
