【摘要】：福建"雙學(xué)位風(fēng)波"和武漢大學(xué)"雙學(xué)位"案,引發(fā)了社會(huì)輿論對(duì)"雙學(xué)位"合法性的廣泛關(guān)注。由于高等教育相關(guān)立法的缺失和高校對(duì)學(xué)位授予權(quán)認(rèn)識(shí)的滯后,"雙學(xué)位"的合法性以及司法救濟(jì)途徑一直存有爭(zhēng)議。在剖析雙學(xué)位法律性質(zhì)的基礎(chǔ)上,通過(guò)比對(duì)雙學(xué)位與第二學(xué)位的區(qū)別,提出了認(rèn)可高校授予學(xué)位辦學(xué)自主權(quán),確立學(xué)校學(xué)位制度,合理解決雙學(xué)位合法性問(wèn)題的建議。
[Abstract]:The case of double degrees in Fujian Province and Wuhan University has aroused widespread concern about the legitimacy of double degrees. Due to the lack of legislation related to higher education and the lagging understanding of the right to grant degrees in colleges and universities, the legitimacy of "double degrees" and the way of judicial relief have always been controversial. On the basis of analyzing the legal nature of double degree and comparing the difference between double degree and the second degree, this paper puts forward some suggestions to recognize the autonomy of university to grant degree, to establish the system of university degree, and to solve the problem of legitimacy of double degree reasonably.
