【摘要】：公共資源交易領(lǐng)域綜合行政執(zhí)法的變革正在全國如火如荼進(jìn)行,然而卻存在著變革的合法性危機(jī)。遵循法律程序的要件,同時符合法律授權(quán)的內(nèi)容,是變革的前提和基礎(chǔ)。"該得到法律授權(quán)的不能超前推進(jìn)","要協(xié)調(diào)推進(jìn)改革"是公共資源交易領(lǐng)域綜合行政執(zhí)法改革必須遵照的原則。合肥市以立法形式大膽創(chuàng)新公共資源執(zhí)法體制,值得肯定,但也要得到法律的特別授權(quán)。各地政府應(yīng)充分考慮各自實際情況,合法有序推進(jìn)公共資源交易綜合行政執(zhí)法改革。
[Abstract]:The reform of comprehensive administrative law enforcement in the field of public resource transaction is in full swing all over the country, but there is a crisis of legitimacy of the reform. Compliance with the elements of legal procedure and with the content of legal authorization is the prerequisite and basis for change. " It is the principle that the comprehensive administrative law enforcement reform in the field of public resource transaction must be carried out according to the principle of "to coordinate and push forward the reform". Hefei innovates the law enforcement system of public resources in the form of legislation, which is worthy of recognition, but it also needs special authorization from the law. Local governments should give full consideration to their actual conditions and promote the reform of comprehensive administrative law enforcement of public resource transactions legally and in an orderly manner.
