【摘要】：控制并減少毒品已經(jīng)成為國際通識(shí),但在這一宏觀目標(biāo)之下,如何控制毒品的政策取向以及制度與措施的具體選擇卻存有差異。政策因素主導(dǎo)著制度的構(gòu)建與措施的選擇,是體現(xiàn)某一國家或地區(qū)對(duì)于毒品態(tài)度的重要特征。毒品政策表達(dá)了國家基于政治、文化、社會(huì)乃至道德等諸多因素而限制或者容忍毒品的基本態(tài)度。由于國家與市民社會(huì)二元對(duì)立與融合的狀況,國家的毒品控制、市民個(gè)體的權(quán)利訴求以及市民社會(huì)的秩序渴望對(duì)毒品政策的形成提供條件,也對(duì)其產(chǎn)生約束。毒品政策已然從統(tǒng)一的國家意識(shí)層面引入到分散的個(gè)人或者公共領(lǐng)域,充分體現(xiàn)了國家意志與市民社會(huì)需求之間的矛盾。梳理并分析毒品政策在這一矛盾中產(chǎn)生的源流、導(dǎo)向以及成效,能夠?yàn)槲覈酒氛叩膬r(jià)值判斷與路徑選取提供有益的思考與借鑒。
[Abstract]:The control and reduction of drugs has become an international knowledge, but under this macro goal, there are differences in how to control the drug policy orientation and the specific choice of the system and measures. The policy factor dominates the construction of system and the choice of measures, which is an important feature of a country or region's attitude towards drugs. Drug policy expresses the country's basic attitude of restricting or tolerating drugs on the basis of political, cultural, social and even moral factors. Due to the dual opposition and integration of the state and the civil society, the drug control of the country, the individual rights demands of the citizens and the order of the civil society desire to provide the conditions for the formation of drug policy, and also have constraints on the formation of drug policy. Drug policy has been introduced from the level of unified national consciousness to the scattered individual or public sphere, which fully reflects the contradiction between national will and the needs of civil society. Combing and analyzing the origin, orientation and effect of drug policy in this contradiction can provide beneficial thinking and reference for the value judgment and path selection of drug policy in our country.
