【摘要】：正"網(wǎng)絡(luò)有害信息"的提法在學(xué)術(shù)界甚為流行,已經(jīng)作為一個專有學(xué)術(shù)名詞在論文主題中頻頻使用。"從實證法的角度看,作為法律規(guī)制對象的有害信息雖然實際上也是違法信息,但使用有害信息的概念,更有利于保持網(wǎng)絡(luò)安全相關(guān)立法的動態(tài)性,以便能夠適時將現(xiàn)行立法未規(guī)定的有害信息納入規(guī)制范圍。"1但該名詞也存在定義不清、適用范圍過寬2等問題。目前對網(wǎng)絡(luò)有害信息的討論也多集中在網(wǎng)絡(luò)有害信息與表達自由、刑法規(guī)制、
