【摘要】：住房是人類生存的基本物質要素,是人們生活最基本的物質需求。保障性住房是解決中低收入家庭居住問題的重要舉措,是社會保障制度在住房領域的體現。目前中國保障性住房建設法律制度相對滯后,還存在諸多問題尚未解決,有待完善。英國是世界上率先完成工業(yè)化的國家,對住房問題的研究也起步較早。英國在探索建設保障性住房的過程中,積累了許多寶貴的經驗。鑒于此,我們有必要對英國保障性住房建設法律制度的歷史沿革進行梳理研究,總結其現行保障性住房建設法律制度的特征,分析其成因。結合我國在建設保障房過程中遇到的問題,為我國保障性住房建設法律制度的設立和完善提供可借鑒的經驗和啟示,更加積極推進我國保障性住房建設法律制度的完善。本文擬綜合使用歷史研究、文獻研究、比較研究及規(guī)范分析等方法,以英國保障性住房建設法律制度為研究對象,重點剖析現行英國保障性住房建設法律制度的特征及成因,試圖以此把握英國保障性住房建設法治化的規(guī)律,進而對我國保障性住房建設法治化提供有益經驗啟示。全文共分為四部分:第一部分為英國保障性住房建設法律制度沿革。從歷史發(fā)展的角度梳理了英國保障性住房建設法律制度的歷史沿革,將其分為保障性住房建設法律制度的初創(chuàng)時期和發(fā)展時期。初創(chuàng)時期的保障性住房建設法律制度有其特點:明確住房建設主體、征收和規(guī)劃建設用地、列舉住房建設程序、構建住房建設標準、開列住房建設監(jiān)管制度、初設住房重建制度。發(fā)展時期的保障性住房建設法律制度的特點有:增加住房建設主體、細化住房建設規(guī)劃制度、轉變住房建設標準、細化住房建設監(jiān)管制度、明確住房建設資金渠道、規(guī)范住房重建程序制度。第二部分為現行英國保障性住房建設法律制度的特征分析。現行英國保障性住房建設法律制度的特征表現為:保障性住房的建設主體多元化、保障性住房的建設標準嚴格化、保障性住房的建設用地科學化、保障性住房的建設資金多渠道化、保障性住房的建設監(jiān)管制度精細化、保障性住房重建制度的程序化。第三部分為現行英國保障性住房建設法律制度特征的成因分析。現行英國保障性住房建設法律制度特征的成因為:分散政府財政負擔、城市規(guī)劃與可持續(xù)發(fā)展的需求、公眾住房需求的提升、完善住房建設法律制度的要求。第四部分為英國保障性住房建設法律制度的經驗啟示。該部分首先分析了中國保障性住房建設法律制度存在的問題,即缺乏完善的住房法律制度體系;住房建設用地管理制度不健全;住房建設資金籌集渠道單一;住房建設監(jiān)管機制不健全等。在此基礎上,從比較法的角度借鑒英國保障性住房建設法律制度的經驗,提出完善我國保障性住房建設法律制度的啟示:完善保障性住房法律體系;健全保障性住房建設法律制度;完善與保障性住房建設相關的法律制度。
[Abstract]:Housing is the basic material factor of human existence and the basic material demand of people's life. The guarantee housing is an important measure to solve the problem of living in the middle and low income families. It is the embodiment of the social security system in the housing field. At present, the legal system of the construction of the safeguard housing is lagging behind in China, and there are still many problems to be solved. The UK is the first country in the world to complete the industrialization, and the research on the housing problem has started earlier. Britain has accumulated a lot of valuable experience in the process of exploring the construction of affordable housing. In view of this, it is necessary for us to study the history of the legal system of the British security housing construction and summarize its current guarantee. The characteristics of the legal system of sexual housing construction, analysis of its causes, combined with the problems encountered in the process of building the guarantee housing in China, provide useful experience and inspiration for the establishment and improvement of the legal system for the construction of the guarantee housing construction in our country, and further promote the perfection of the legal system of the construction of the guarantee housing in our country. In the study of literature, comparative study and normative analysis, this paper takes the legal system of British affordable housing construction as the research object, focuses on the analysis of the characteristics and causes of the legal system of the existing British affordable housing construction, trying to grasp the rule of the rule of law in the construction of British affordable housing, and then to the rule of law in the construction of China's guarantee housing. The full text is divided into four parts: the first part is the evolution of the legal system of British affordable housing construction. From the perspective of historical development, the historical evolution of the legal system of British affordable housing construction is combed, which is divided into the initial period and development period of the legal system of the construction of guaranteed housing. The legal system of housing construction has its own characteristics: the main body of housing construction, the collection and planning and construction land, the listing of housing construction procedures, the construction standards of housing construction, the establishment of housing construction supervision system and the establishment of housing reconstruction system. The characteristics of the legal system of the housing construction during the development period include the increase of the main body of housing construction and the refine of housing construction. Plan system, change housing construction standards, refine housing construction supervision system, clear housing construction fund channels, standardize housing reconstruction procedure system. The second part is the characteristic analysis of the current British security housing construction legal system. The current British security housing law system is characterized by the construction of the guarantee housing construction. The third parts include the diversification of the main body, the strictness of the construction standard of the guarantee housing, the science of the construction land for the guarantee housing, the multi channel of the construction funds of the guarantee housing, the fine supervision system of the construction of the guarantee housing and the procedure of the system of the reconstructive housing reconstruction. Because of the analysis, the characteristics of the legal system of the current British housing construction are: decentralizing the financial burden of the government, the demand for urban planning and sustainable development, the promotion of public housing demand, and the requirements for the improvement of the legal system of housing construction. The fourth part is the experience of the legal system of the construction of British affordable housing. The existing problems in the legal system of China's guarantee housing construction are the lack of perfect legal system of housing, the unsound management system of housing construction land, the single channel of raising funds for housing construction and the unsound supervision mechanism of housing construction. On the basis of this, the legal system of the construction of British affordable housing is drawn from the angle of comparative law. The Enlightenment of improving the legal system of the housing construction in China is put forward: perfecting the legal system of the affordable housing, perfecting the legal system of the construction of the affordable housing, and perfecting the legal system related to the construction of the affordable housing.
