【摘要】：針對重慶市采礦權(quán)實(shí)地核查及儲量動態(tài)檢測的監(jiān)督管理等方面,以實(shí)地核查及儲量動態(tài)監(jiān)測制度落實(shí)為主要依據(jù),對監(jiān)管機(jī)制現(xiàn)狀和存在問題開展研究。重慶市2013年起各區(qū)縣(自治縣)逐步開展并落實(shí)采礦權(quán)實(shí)地核查及儲量動態(tài)檢測制度,在發(fā)現(xiàn)違法違規(guī)問題等方面取得重要成果。重慶市采礦權(quán)開采和管理主要涉及的監(jiān)管主體包括重慶市國土資源和房屋管理局、重慶市安全生產(chǎn)監(jiān)督管理局、重慶市煤礦安全監(jiān)察局和重慶市煤炭工業(yè)管理局。采礦權(quán)實(shí)地核查及儲量動態(tài)檢測監(jiān)管內(nèi)容包括維護(hù)礦山開采安全、規(guī)范礦山開采秩序和保護(hù)地質(zhì)環(huán)境,保障可持續(xù)發(fā)展。當(dāng)前監(jiān)管機(jī)制存在的問題包括3個(gè)方面:1)監(jiān)管職能部門交叉;2)職責(zé)不夠明確、礦山違法行為突出;3)預(yù)防、處罰機(jī)制不夠健全、儲量動態(tài)檢測與儲量管理未進(jìn)行有效銜接。健全當(dāng)前監(jiān)管機(jī)制的相關(guān)對策主要為:1)明確實(shí)地核查及儲量動態(tài)檢測工作原則,確定各方職責(zé);2)積極落實(shí)實(shí)地核查制度,加強(qiáng)礦山企業(yè)問題的發(fā)現(xiàn)和處理;3)建立動態(tài)檢測數(shù)據(jù)庫,將動態(tài)檢測工作與儲量管理有機(jī)銜接。
[Abstract]:In view of the field verification of mining rights in Chongqing and the supervision and management of the dynamic reserve testing of reserves, the current situation and existing problems of the regulatory mechanism are studied on the basis of field verification and the implementation of the reserve dynamic monitoring system. In 2013, Chongqing city has gradually carried out and implemented the field verification of mining rights and the dynamic testing of reserves in each district and county (Autonomous County). The system has made important achievements in the discovery of illegal and illegal problems. The main regulatory bodies involved in mining and management of mining rights in Chongqing include Chongqing land resources and housing administration, Chongqing safety supervision and Administration Bureau, Chongqing Coal Mine Safety Supervision Bureau and Chongqing Coal Industry Administration Bureau. Mining rights field verification and reserves The contents of dynamic monitoring and supervision include maintaining mining safety, regulating mining order and protecting geological environment, guaranteeing sustainable development. There are 3 aspects of current regulatory mechanism: 1) cross regulation of supervisory functions, 2) lack of clear responsibility, outstanding illegal mining behavior, 3) prevention, inadequate punishment mechanism and dynamic reserve testing of reserves. There are no effective links with reserves management. The main measures to improve the current regulatory mechanism are as follows: 1) clear field verification and reserve dynamic testing principles, determine the responsibilities of all parties; 2) actively implement the field verification system, strengthen the discovery and treatment of mine enterprise problems; 3) establish dynamic testing database, and the dynamic testing work and reserves management Link up with organic matter.
