我國(guó)區(qū)域間行政協(xié)定糾紛解決制度研究

【摘要】:改革開(kāi)放以來(lái),我國(guó)社會(huì)經(jīng)濟(jì)取得了全面發(fā)展,在行政法領(lǐng)域出現(xiàn)了許多新制度,區(qū)域間行政協(xié)定即是我國(guó)在經(jīng)濟(jì)社會(huì)發(fā)展中為彌補(bǔ)區(qū)域間發(fā)展差距,減少行政壁壘,實(shí)現(xiàn)經(jīng)濟(jì)要素跨區(qū)域流動(dòng)而設(shè)立的制度,在處理跨區(qū)域事物中發(fā)揮了重要作用,然而在我國(guó)現(xiàn)行法律法規(guī)中還沒(méi)有對(duì)區(qū)域間行政協(xié)定作出專(zhuān)門(mén)規(guī)定,實(shí)踐中對(duì)于區(qū)域間行政協(xié)定的法律適用大多套用其他法律法規(guī)。學(xué)者在該領(lǐng)域的研究主要是在概念的提出,在具體的制度構(gòu)建方面的研究較為籠統(tǒng),缺乏深入細(xì)致的研究。 本研究以區(qū)域間行政協(xié)定運(yùn)行中的重要一環(huán)-糾紛解決制度為著手之處,利用文獻(xiàn)研究法以及比較研究法,對(duì)區(qū)域間行政協(xié)定糾紛解決制度進(jìn)行了較為全面系統(tǒng)的探討。本文主要分為以下幾個(gè)部分: 第一部分,我國(guó)區(qū)域間行政協(xié)定糾紛解決制度基本理論,首先介紹了區(qū)域間行政協(xié)定的涵義、特征與意義,分析了區(qū)域間行政協(xié)定的概念,區(qū)域間行政協(xié)定產(chǎn)生的現(xiàn)實(shí)背景,以及在區(qū)域經(jīng)濟(jì)一體化中的作用。其次介紹了區(qū)域間行政協(xié)定糾紛解決制度,著重分析了區(qū)域間行政協(xié)定糾紛的主要表現(xiàn)形式及責(zé)任性質(zhì)。最后介紹了區(qū)域間行政糾紛解決制度的國(guó)內(nèi)外現(xiàn)狀,以及該項(xiàng)制度的完善。 第二部分,我國(guó)區(qū)域間行政協(xié)定糾紛行政解決機(jī)制,該部分首先介紹了目前我國(guó)區(qū)域間行政協(xié)定糾紛解決制度的現(xiàn)狀,,行政解決機(jī)制雖然效率高,但程序的不公開(kāi)也是其明顯的缺陷。其次立足于我國(guó)現(xiàn)狀,提出了對(duì)行政解決機(jī)制的完善措施。 第三部分,我國(guó)區(qū)域間行政協(xié)定糾紛司法解決機(jī)制的構(gòu)想,司法機(jī)制可以很好的彌補(bǔ)行政解決機(jī)制的弊端,讓公正得以看得見(jiàn)的方式實(shí)現(xiàn),在這方面歐美等國(guó)家已經(jīng)有許多成功的經(jīng)驗(yàn)可以借鑒,從目前的趨勢(shì)看,行政機(jī)關(guān)之間的糾紛通過(guò)司法途徑解決已是大勢(shì)所趨。在具體的制度設(shè)計(jì)方面主要從主管法院、受理?xiàng)l件、起訴主體等方面進(jìn)行構(gòu)建。 第四部分,我國(guó)區(qū)域間行政協(xié)定糾紛仲裁解決機(jī)制的構(gòu)想,該部分主要介紹了美國(guó)在處理州際協(xié)定糾紛方面的做法,以仲裁方式解決行政機(jī)關(guān)之間的糾紛具有簡(jiǎn)捷高效等優(yōu)勢(shì),是對(duì)行政解決機(jī)制和司法解決機(jī)制很好的補(bǔ)充,對(duì)構(gòu)建我國(guó)行政協(xié)定糾紛解決機(jī)制有一定的借鑒意義。
[Abstract]:Since the reform and opening up, our country's social economy has made a comprehensive development, and there are many new systems in the field of administrative law. The interregional administrative agreement is the system set up to make up the gap between regions, reduce administrative barriers and realize the trans regional flow of economic factors in the economic and social development, and play a role in dealing with trans regional things. However, in the current laws and regulations in China, there is no special provision for interregional administrative agreements. In practice, most of the legal applications of interregional administrative agreements apply to other laws and regulations. The research in this field is mainly on the concept, and the research on specific system construction is more general and lack of depth. A careful study.
This study takes the important part of the operation of inter regional administrative agreements as an important part of the dispute settlement system, and makes a comprehensive and systematic discussion on the dispute settlement system of interregional administrative agreements by using the literature research method and comparative study method. This paper is divided into the following parts:
The first part, the basic theory of the dispute settlement system of interregional administrative agreements, first introduces the meaning, characteristics and significance of interregional administrative agreements, analyzes the concept of interregional administrative agreements, the realistic background of the emergence of interregional administrative agreements, and the role in the integration of regional economy. Secondly, it introduces the correction of inter regional administrative agreements. In order to solve the system, the main forms and nature of the disputes between regions are analyzed. Finally, the current situation at home and abroad and the perfection of the system are introduced.
The second part, the administrative settlement mechanism of the interregional administrative agreement in our country, this part first introduces the present situation of the dispute settlement system of the interregional administrative agreement in our country. Although the administrative settlement mechanism is high efficiency, the procedure is also its obvious defect. Secondly, it puts forward the perfection of the administrative settlement mechanism based on the current situation of our country. Measures.
The third part, the conception of judicial settlement mechanism of dispute between regional administrative agreements in our country, the judicial mechanism can make up the malpractice of the administrative settlement mechanism well and let the justice be realized. In this respect, the European and American countries have already had many successful experiences for reference. From the present trend, the disputes among the administrative organs are through. It is a general trend to solve the problem through judicial channels. In terms of the specific system design, it is mainly constructed from the competent court, the conditions of acceptance, the subjects of prosecution and so on.
The fourth part, the concept of arbitration settlement mechanism of interregional administrative agreement disputes in our country, this part mainly introduces the practice of the United States in dealing with interstate agreement disputes, and it is simple and efficient to solve the disputes between administrative organs by arbitration. It is a good supplement to the administrative settlement mechanism and the judicial settlement mechanism, and the construction of our country. The administrative agreement dispute resolution mechanism has certain reference significance.
