【摘要】:隨著我國經(jīng)濟(jì)的高速增長,城鄉(xiāng)建設(shè)步伐的加快,城鎮(zhèn)化水平的急速推進(jìn),城鄉(xiāng)規(guī)劃作為保障城鎮(zhèn)健康有序發(fā)展的公共政策,發(fā)揮著越來越重要的作用。而與此同時(shí),一些無視規(guī)劃進(jìn)行建設(shè)活動(dòng)的行為也變得日益普遍,這些違法建設(shè)不僅侵害了公共資源、破壞了社會環(huán)境、制約了城鄉(xiāng)發(fā)展,而且還存在安全隱患,可能危及到人民的生命財(cái)產(chǎn)安全,因此需要我們下大力氣加以整治。而行政機(jī)關(guān)在對無視規(guī)劃的違法建設(shè)進(jìn)行查處,實(shí)施行政強(qiáng)制執(zhí)行權(quán)時(shí),卻常常是沖突四起、矛盾重重,成為行政執(zhí)法中的難點(diǎn),顯然面臨著不小的問題與挑戰(zhàn)。本文基于這樣的背景,立足現(xiàn)狀,抓住城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行這個(gè)核心,解析其存在的問題并探索可以完善的路徑。 本文主要分為五個(gè)部分。第一部分,是對本篇論文基本特征的簡介,闡述了論文寫作的相關(guān)背景、意義以及研究思路。第二部分,首先從城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行的概論入手,介紹了行政強(qiáng)制執(zhí)行的概念和特征,城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行的概念、特征以及應(yīng)當(dāng)遵循的基本原則。第三部分,主要是梳理城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行的相關(guān)立法,從立法沿革的角度進(jìn)行闡述。在立法沿革中,從城鄉(xiāng)規(guī)劃和行政強(qiáng)制兩個(gè)方面展開,并總結(jié)出它們在立法沿革過程中呈現(xiàn)出的特點(diǎn)。第四部分,分析了我國目前城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行存在的一些問題,分別從立法、實(shí)施機(jī)制以及救濟(jì)的角度進(jìn)行闡述。立法中的問題主要體現(xiàn)在有關(guān)立法規(guī)定較為籠統(tǒng),缺乏可操作性以及地方性法規(guī)及規(guī)章存在與上位法相沖突的情形。實(shí)施機(jī)制中的問題主要體現(xiàn)在城鄉(xiāng)規(guī)劃行政強(qiáng)制執(zhí)行未能嚴(yán)格履行程序、執(zhí)行主體缺乏協(xié)作和監(jiān)督這兩個(gè)方面。救濟(jì)中的問題主要體現(xiàn)在司法和非司法救濟(jì)缺乏力度。第五部分,作為本文的重要部分,嘗試提出一些解決問題的具體建議,這些建議也分別圍繞相關(guān)的問題:就立法而言要制定統(tǒng)一的配套實(shí)施細(xì)則、填補(bǔ)法律空缺、規(guī)范地方性法規(guī)和規(guī)章;就實(shí)施機(jī)制而言要構(gòu)建嚴(yán)格的法定程序落實(shí)機(jī)制、充分保證公民在程序中的知情權(quán)和參與權(quán),以及比例原則的適用;明確分工加強(qiáng)協(xié)作、增設(shè)多層次的監(jiān)督體系;救濟(jì)中要完善司法救濟(jì)和非司法救濟(jì)。 本文試圖通過分析為規(guī)范城鄉(xiāng)規(guī)劃管理過程中的行政強(qiáng)制執(zhí)行權(quán),提供一些有效的路徑、找到一些可行的解決方案。
[Abstract]:With the rapid economic growth, the acceleration of the pace of urban and rural construction, and the rapid advancement of urbanization, urban and rural planning, as a public policy to ensure the healthy and orderly development of cities and towns, is playing a more and more important role. At the same time, some acts of disregard for planning for construction activities have become increasingly common. These illegal constructions not only encroach on public resources, destroy the social environment, restrict the development of urban and rural areas, but also have hidden security problems. May endanger the people's lives and property safety, so we need to make great efforts to rectify. However, when the administrative organs investigate and deal with the illegal construction in disregard of the planning, the enforcement of administrative enforcement power is often caused by conflicts, which becomes a difficult point in the administration of law enforcement, and obviously faces not small problems and challenges. Based on this background and the present situation, this paper grasps the core of administrative enforcement of urban and rural planning, analyzes its existing problems and explores the path that can be perfected. This paper is divided into five parts. The first part is a brief introduction to the basic characteristics of this paper, including its background, significance and research ideas. The second part begins with an overview of administrative enforcement of urban and rural planning, introduces the concept and characteristics of administrative enforcement of urban and rural planning, the concept and characteristics of administrative enforcement of urban and rural planning, and the basic principles to be followed. The third part, mainly combing the relevant legislation of administrative enforcement of urban and rural planning, from the perspective of legislative evolution. In the process of legislative evolution, it starts from the two aspects of urban and rural planning and administrative compulsion, and summarizes their characteristics in the process of legislative evolution. The fourth part analyzes some problems existing in the administrative enforcement of urban and rural planning in China, respectively from the perspective of legislation, implementation mechanism and relief. The main problems in the legislation are the general provisions of the relevant legislation, the lack of maneuverability and the conflict between the local laws and regulations and the superior laws. The problems in the implementation mechanism are mainly reflected in the failure to strictly implement the procedures of the administrative enforcement of urban and rural planning, the lack of coordination and supervision of the executive body. The problems in relief are mainly reflected in the lack of judicial and non-judicial remedies. The fifth part, as an important part of this paper, tries to put forward some concrete suggestions to solve the problem. These suggestions also revolve around the related problems. To standardize local laws and regulations; to establish a strict legal procedure implementation mechanism as far as the implementation mechanism is concerned; to fully guarantee citizens' right to know and participate in the procedure, as well as the application of the principle of proportionality; and to make clear the division of labor and strengthen cooperation. A multi-level supervision system should be established, and judicial and non-judicial remedies should be perfected. This paper attempts to provide some effective paths for standardizing the administrative enforcement power in the process of urban and rural planning and management, and to find some feasible solutions.
