基于比例原則下道路交通行政執(zhí)法中存在的問題及其思考

【摘要】:道路交通行政執(zhí)法是貫徹執(zhí)行道路交通法規(guī)的社會性管理活動,其目的在于全面、準(zhǔn)確地執(zhí)行和實現(xiàn)道路交通管理方面的法律、法規(guī)、規(guī)章賦予道路交通行政管理機(jī)關(guān)的行政管理職能,以保障和維護(hù)公民的權(quán)利和自由,保障和維護(hù)道路交通秩序。改革開放20多年來,我國的經(jīng)濟(jì)發(fā)展發(fā)生了翻天覆地的變化,道路交通狀況日益復(fù)雜,道路交通行政執(zhí)法面臨的問題越來越多,而道路交通行政執(zhí)法主體在執(zhí)法過程中必須遵循有關(guān)的法律規(guī)定,做到合法、合理行政,執(zhí)法當(dāng)中的任何不良或不當(dāng)行為都要受到法律的制裁和處罰,這已經(jīng)形成了廣泛地社會共識。但是,在現(xiàn)實生活中執(zhí)法犯法、執(zhí)法腐敗、執(zhí)法不當(dāng)?shù)葐栴}卻在未見消失,尤其在道路交通行政執(zhí)法中更是如此。歸根結(jié)底,道路交通行政執(zhí)法的最大問題就是行政主體在執(zhí)法時,是否考慮到了行政手段的妥當(dāng)性、必要性以及均衡性,也就是行政主體在選擇行政手段時是否考慮到了行政法上的比例原則。行政比例原則在我國道路交通行政執(zhí)法當(dāng)中沒有得到很好的運用,以至于引發(fā)了一些執(zhí)法不力、執(zhí)法的法律效率和社會效率不高的問題。本文擬緊密結(jié)合行政比例原則和道路交通行政執(zhí)法的實際工作,從我國道路交通行政執(zhí)法的現(xiàn)狀入手,圍繞道路交通行政執(zhí)法存在的問題,從立法、執(zhí)法等角度分析這些問題產(chǎn)生的原因,并有針對性地提出了完善思路和建議。全文共分四個部分。 第一部分,是有關(guān)比例原則和道路交通行政執(zhí)法的概述。在闡述比例原則和道路交通行政執(zhí)法概念的基礎(chǔ)上,分析了比例原則的內(nèi)容和道路交通行政執(zhí)法的特點,介紹了比例原則在道路交通行政執(zhí)法當(dāng)中的體現(xiàn)。 第二部分,指明了我國道路交通行政執(zhí)法的現(xiàn)狀。以我國道路交通行政執(zhí)法的現(xiàn)狀出發(fā),,指出了比例原則下道路交通行政執(zhí)法存在的問題,并分析了產(chǎn)生問題的原因。 第三部分,介紹了域外道路交通行政執(zhí)法的比例原則體現(xiàn)。對域外的道路交通相關(guān)法條進(jìn)行了分析,對執(zhí)法行為加以對比,從中找出對我國道路交通行政執(zhí)法的一些啟示。 第四部分,提出了完善交通行政執(zhí)法的總體思路。分析道路交通行政執(zhí)法中重視比例原則的意義,明確從完善法律規(guī)范、細(xì)化裁量基準(zhǔn)、加強(qiáng)司法監(jiān)督、規(guī)范執(zhí)法行為、普及公民參與等方面入手,落腳于比例原則在道路交通行政執(zhí)法中的運用,充分發(fā)揮道路交通行政執(zhí)法的作用。
[Abstract]:Road traffic administrative law enforcement is a social management activity to carry out road traffic laws and regulations. Its purpose is to comprehensively and accurately enforce and realize the laws and regulations of road traffic management. The regulations give the administrative functions of the road traffic administration to protect and safeguard the rights and freedoms of citizens and to protect and maintain the order of road traffic. Over the past 20 years of reform and opening up, the economic development of our country has undergone earth-shaking changes, the road traffic situation has become increasingly complex, and there are more and more problems faced by road traffic administrative law enforcement. In the course of enforcing the law, the main body of road traffic administrative law enforcement must abide by the relevant legal provisions, be lawful and reasonable in administration, and any bad or improper conduct in the enforcement of the law should be punished and punished by the law. This has formed a broad social consensus. However, the problems of breaking the law, corruption and improper law enforcement in real life, especially in the road traffic administrative law enforcement, have not disappeared. In the final analysis, the biggest problem of road traffic administrative law enforcement is whether the administrative subject considers the appropriateness, necessity and balance of administrative means when enforcing the law. That is whether the administrative subject considers the principle of proportion in administrative law when choosing administrative means. The principle of administrative proportionality has not been well applied in the administrative law enforcement of road traffic in China, which has caused some problems such as weak enforcement of law, low efficiency of law enforcement and social efficiency. Based on the principle of administrative proportion and the actual work of road traffic administrative law enforcement, this paper begins with the current situation of road traffic administrative law enforcement in our country, and focuses on the existing problems of road traffic administrative law enforcement. This paper analyzes the causes of these problems from the point of view of law enforcement, and puts forward some ideas and suggestions. The full text is divided into four parts. The first part is an overview of the principle of proportionality and the administrative law enforcement of road traffic. On the basis of expounding the principle of proportion and the concept of administrative law enforcement of road traffic, this paper analyzes the content of the principle of proportion and the characteristics of administrative law enforcement of road traffic, and introduces the embodiment of the principle of proportion in the law enforcement of road traffic administration. The second part, has pointed out our country road traffic administration law enforcement present situation. Based on the present situation of road traffic administrative law enforcement in China, this paper points out the problems existing in road traffic administrative law enforcement under the principle of proportionality, and analyzes the causes of the problems. The third part introduces the principle of proportionality of road traffic administrative law enforcement. This paper analyzes the relevant laws on road traffic outside the country, compares the law enforcement behavior, and finds out some enlightenment to our country's road traffic administrative law enforcement. The fourth part, has proposed the overall thought which consummates the traffic administration law enforcement. This paper analyzes the significance of paying attention to the principle of proportionality in the administrative law enforcement of road traffic, and makes clear the following aspects: perfecting the legal norms, refining the standard of discretion, strengthening judicial supervision, standardizing law enforcement, popularizing citizen participation, etc. The application of the principle of proportion in the law enforcement of road traffic administration, giving full play to the role of administrative law enforcement of road traffic.
