【摘要】：本文通過(guò)考查美國(guó)州和地方的政策法規(guī)及處分決定,描述和分析美國(guó)對(duì)公立學(xué)校教師從事有償補(bǔ)課進(jìn)行法律規(guī)制的范圍、原理、目的、手段以及相關(guān)懲戒制度,發(fā)現(xiàn)美國(guó)地方政府通常"有條件禁止"教師從事有償補(bǔ)課。由此,本文主張對(duì)公立學(xué)校教師從事有償補(bǔ)課進(jìn)行法律規(guī)制的基礎(chǔ)是教師避免利益沖突的義務(wù),這一規(guī)制同時(shí)需要滿足目的合法和手段合理的要求。與美國(guó)相比,我國(guó)對(duì)教師有償補(bǔ)課行為的規(guī)制具有全國(guó)性政策但是效力不高、限制范圍寬泛并突出規(guī)制"有組織"的行為、缺乏對(duì)規(guī)制目的和手段的細(xì)致論證以及重實(shí)體輕程序、重懲戒輕預(yù)防的特點(diǎn),本文對(duì)此提出了有針對(duì)性的改進(jìn)建議。
[Abstract]:This paper describes and analyzes the scope, principle, purpose, means and relevant disciplinary system of the legal regulation of public school teachers engaging in compensatory supplementary courses in the United States by examining the policies, regulations and disciplinary decisions of the states and localities in the United States. It was found that local governments in the United States often "conditionally prohibit" teachers from engaging in paid supplementary classes. Therefore, this paper argues that the legal regulation of public school teachers engaged in compensatory courses is based on the teachers' obligation to avoid conflicts of interest, and this regulation needs to meet the requirements of legal purpose and reasonable means at the same time. Compared with the United States, our country has a national policy on teachers' compensatory supplementary courses, but the effectiveness is not high, the scope of restrictions is broad and the regulation of "organized" behavior is highlighted. There is a lack of detailed argumentation on the purpose and means of regulation, as well as the characteristics of paying more attention to substance and procedure, to punishment than to prevention. This paper puts forward some suggestions for improvement.
