【摘要】：正工業(yè)化和城鎮(zhèn)化的發(fā)展,對(duì)土地的利用逐漸由平面向地上和地下空間延伸,形成垂直式的分層立體利用,空間權(quán)概念也應(yīng)運(yùn)而生。盡管關(guān)于土地空間權(quán)的法律制度在西方國(guó)家早已建立,但在我國(guó)至今仍不健全,且不同層面和人群對(duì)空間、空間權(quán)的概念及理論問(wèn)題尚有較大爭(zhēng)議。因此,在土地空間開(kāi)發(fā)實(shí)踐不斷深化的當(dāng)前,應(yīng)加強(qiáng)城市土地空間權(quán)制度構(gòu)建和土地利用潛力研究。城市土地立體空間利用是必然趨勢(shì)人類在利用土地物質(zhì)的同時(shí),也在利用土
[Abstract]:With the development of industrialization and urbanization, the use of land gradually extends from plane to ground and underground space, forming vertical stratified and stereoscopic utilization, and the concept of spatial right emerges as the times require. Although the legal system of land space right has long been established in western countries, it is still not perfect in our country, and the concept and theory of space right are still controversial in different levels and groups. Therefore, with the deepening of land space development practice, we should strengthen the construction of urban land spatial right system and the study of land use potential. The utilization of urban land three-dimensional space is an inevitable trend. Human beings are using the soil as well as the land material at the same time.
