【摘要】：隨著我國(guó)經(jīng)濟(jì)的迅速發(fā)展，新聞傳媒行業(yè)也隨之得到快速發(fā)展，尤其是網(wǎng)絡(luò)的興起，使得網(wǎng)絡(luò)不再是一個(gè)純粹的工具或者是平臺(tái)，而是已成為繼報(bào)刊、電視、廣播之后迅猛發(fā)展起來的第四新媒體，給傳統(tǒng)大眾傳播環(huán)境帶來了巨大的變化。尤其是博客、微博、網(wǎng)絡(luò)論壇等信息發(fā)布平臺(tái)的出現(xiàn)，再加之網(wǎng)絡(luò)本身所具有的開放性、互動(dòng)性等特點(diǎn)，使得網(wǎng)絡(luò)不僅僅是傳統(tǒng)新聞發(fā)布者的發(fā)布平臺(tái)，已不再僅僅是官方語言，每個(gè)網(wǎng)民都有可能成為網(wǎng)絡(luò)記者，將自己的所見所聞、所感所想，或是自己所拍攝的影響圖片等通過網(wǎng)絡(luò)進(jìn)行傳播，都有可能成為新聞信息。 當(dāng)然，當(dāng)網(wǎng)絡(luò)新聞在給人們帶來充分的言論自由的時(shí)候，也會(huì)成為一些人為了達(dá)到個(gè)人目的而用來傷害他人的強(qiáng)大“武器”，例如一些信息的發(fā)布有可能演變成一場(chǎng)赤裸裸的人肉搜索，易致被聚焦對(duì)象的權(quán)利遭受重大損失。其中主要是以侵害民事權(quán)利為主，，但又由于我國(guó)相關(guān)法律的不完善，使得其權(quán)利得不到最大限度的救濟(jì)，因此，在我們享受網(wǎng)絡(luò)帶來的便利和充分的言論自由的同時(shí)，要運(yùn)用好相關(guān)法律，保護(hù)好當(dāng)事人的合法權(quán)益。但是，怎么樣正確看待網(wǎng)絡(luò)新聞給我們生活帶來的變化，如何規(guī)范網(wǎng)絡(luò)新聞管理和規(guī)制，如何更好地保護(hù)當(dāng)事人的合法權(quán)益，以及怎樣預(yù)防網(wǎng)絡(luò)新聞侵權(quán)行為的發(fā)生，這些都是亟需我們?nèi)ニ伎己徒鉀Q的問題。而本文針對(duì)以上問題，主要結(jié)合網(wǎng)絡(luò)新聞本身的特點(diǎn)，從網(wǎng)絡(luò)新聞侵權(quán)行為責(zé)任承擔(dān)、構(gòu)成要件、侵權(quán)類型、新聞侵權(quán)的立法現(xiàn)狀及完善立法建議等角度，結(jié)合具體案件進(jìn)行研究探討。 第一章結(jié)合網(wǎng)絡(luò)新聞侵權(quán)的自身特點(diǎn)來分析其侵權(quán)構(gòu)成要件，進(jìn)而探討其侵權(quán)類型，以此來判斷某行為是否屬于網(wǎng)絡(luò)新聞侵權(quán)行為，以及為行為人承擔(dān)侵權(quán)責(zé)任提供法律依據(jù)；第二章具體探討網(wǎng)絡(luò)新聞侵權(quán)的責(zé)任承擔(dān)，主要包括侵權(quán)主體以及歸責(zé)原則等內(nèi)容，以此來保證被侵權(quán)人的權(quán)利得到救濟(jì)，同時(shí)針對(duì)網(wǎng)絡(luò)新聞侵權(quán)后果的嚴(yán)重性對(duì)懲罰性賠償制度進(jìn)行探討，進(jìn)而更加合理地保護(hù)權(quán)利人的合法權(quán)益；第三章探討網(wǎng)絡(luò)新聞侵權(quán)的抗辯事由，之所以對(duì)其抗辯事由的分析單列一章，是因?yàn)榫W(wǎng)絡(luò)新聞畢竟是個(gè)新興事物，為了確保網(wǎng)絡(luò)新聞業(yè)的健康快速發(fā)展，在充分保障權(quán)利人合法權(quán)益的同時(shí)不能一味地偏向于被侵權(quán)者而至使網(wǎng)絡(luò)新聞事業(yè)受到阻礙，因此對(duì)其抗辯事由進(jìn)行細(xì)致探討進(jìn)而保障其自身利益和健康發(fā)展；第四章則是借鑒國(guó)外先進(jìn)的相關(guān)網(wǎng)絡(luò)新聞立法模式，并結(jié)合我國(guó)的立法現(xiàn)狀，為完善現(xiàn)有立法提出相關(guān)建議，進(jìn)而平衡各方利益。
[Abstract]:With the rapid development of China's economy, the news media industry has also been rapidly developed, especially the rise of the network, so that the network is no longer a pure tool or platform, but has become a newspaper, television, The fourth new media, which developed rapidly after broadcasting, brought great changes to the traditional mass media environment. In particular, the emergence of information publishing platforms such as blogs, Weibo and Internet forums, coupled with the openness and interactivity of the network itself, make the network not only a traditional publishing platform for news publishers. It is no longer just an official language, every netizen can become a network reporter, what they see, what they feel, what they think, or the influence pictures they take through the network, they can become news information. Of course, when Internet news gives people full freedom of speech, it can also become a powerful "weapon" that some people use to harm others in order to achieve their personal goals. For example, the release of some information may turn into a naked human flesh search, which can easily cause the rights of the focused object to suffer a significant loss. It mainly infringes civil rights, but because of the imperfection of relevant laws in our country, it can't get the maximum remedy. Therefore, while we enjoy the convenience and the full freedom of speech brought by the network, We should make good use of relevant laws and protect the legitimate rights and interests of the parties concerned. However, how to correctly view the changes brought about by network news to our lives, how to regulate the management and regulation of network news, how to better protect the legitimate rights and interests of the parties concerned, and how to prevent the occurrence of infringing acts of network news, These are the problems we need to think about and solve. In view of the above problems, this paper mainly combines the characteristics of the network news, from the network news tort liability, constitutive requirements, tort types, news tort legislation status quo and perfect legislative suggestions, and so on. Combined with specific cases for research and discussion. The first chapter analyzes the constitutive elements of network news tort, and then discusses its tort type, so as to judge whether an act belongs to network news tort and provide legal basis for the perpetrator to bear the tort liability. The second chapter specifically discusses the responsibility of network news tort, including the main body of infringement and the principle of imputation, so as to ensure the rights of the infringed person to get relief. At the same time, according to the seriousness of the network news tort consequences of punitive damages system is discussed, and then more reasonable protection of the legitimate rights and interests of the obligee. Chapter III discusses the defense of network news infringement, The reason for the analysis of its defenses is that, after all, Internet news is a new thing. In order to ensure the healthy and rapid development of the online news industry, While fully protecting the legitimate rights and interests of the right holder, we should not blindly favor the infringed person and even hinder the network news cause, so the defense reasons are discussed in detail to ensure their own interests and healthy development; The fourth chapter is to draw lessons from the foreign advanced network news legislation model, and combined with the current situation of legislation in China, to improve the existing legislation put forward relevant suggestions, and then balance the interests of all parties.
