全面依法治國視閾下的高校依法治理

【摘要】:在全面依法治國背景下,高校依法治理是實(shí)現(xiàn)高校治理體系和治理能力現(xiàn)代化、推動高校"雙一流"建設(shè)應(yīng)對國際高等教育競爭、規(guī)范高校自身運(yùn)行的迫切需要。高校依法治理目前存在的主要問題是:對高校黨委行政的關(guān)系認(rèn)識不清晰、從人治到法治的思維轉(zhuǎn)型尚未完成、適應(yīng)高校職能不斷擴(kuò)展等依法治校能力明顯欠缺等。高校應(yīng)堅持黨委領(lǐng)導(dǎo)與依法治校是一致的,運(yùn)用法治思維與法治方式是依法治校的核心能力,通過建立分設(shè)高校黨委、行政法律顧問制度、設(shè)立專門的校內(nèi)法律事務(wù)機(jī)構(gòu)等措施提升高校的法治氣質(zhì),實(shí)現(xiàn)高校治理體系和治理能力現(xiàn)代化。
[Abstract]:Under the background of running the country according to law in an all-round way, it is an urgent need to realize the modernization of university governance system and governance ability, to promote the construction of "double first-class" colleges and universities to cope with the international competition of higher education and to standardize the operation of colleges and universities themselves. The main problems existing in university administration according to law are that the relationship between Party committee and administration is not clear, the transformation of thinking from rule by man to rule by law has not been completed, and the ability of running schools according to law is obviously lacking, such as the continuous expansion of functions in colleges and universities. Colleges and universities should insist that the leadership of the Party committee is consistent with the administration of the school according to law, that the core ability of running the school according to law is to use the thinking of rule by law and the way of ruling by law, and that the system of party committees and administrative legal advisers should be established separately. The establishment of special internal legal affairs institutions and other measures to promote the rule of law in colleges and universities to achieve the governance system and governance capacity modernization.
