【摘要】：《政府信息公開條例》規(guī)定,醫(yī)療衛(wèi)生等與人民群眾利益密切相關(guān)的公共企事業(yè)單位在提供社會公共服務(wù)過程中制作、獲取的信息的公開,"參照"條例執(zhí)行,但具體如何"參照"卻不清晰。病患醫(yī)療信息的公開所面臨的正是這樣一個問題。條例中可資"參照"的主要為個人隱私禁止公開條款。"參照"該條規(guī)定,雖然并非所有病患醫(yī)療信息都不能公開,但那些依據(jù)公眾普遍認知可界定為個人隱私的病患個人醫(yī)療信息,是不得公開的。不過,涉及個人隱私的病患個人診療信息的不公開并不是絕對的,或者可基于病患個人同意而公開,或者可基于重要公共利益或第三人利益的考慮而強制公開。強制公開應(yīng)分別考慮公開的對象、疾病的危害性和病患的身份等因素,公開程度也可視具體情形而收縮。
[Abstract]:The regulations on the publicity of Government Information stipulate that public enterprises and institutions, such as medical and health services, which are closely related to the interests of the people, shall, in the course of providing social and public services, make public the information obtained and implement the regulations "with reference to" the regulations. But how to "reference" is not clear. The disclosure of patient medical information is precisely such a problem. The main provisions of the regulations that can be referred to are the prohibition of disclosure of personal privacy. " According to the Article, although not all patient medical information is not publicly available, those patient medical information that can be defined as privacy by general public perception shall not be made public. However, the non-disclosure of the patient's personal diagnosis and treatment information involving personal privacy is not absolute, or can be made public on the basis of the patient's personal consent, or based on the consideration of the important public interest or the third party's interest. Compulsory disclosure should take into account the object of disclosure, the harm of disease and the identity of the patient, and the degree of disclosure may be reduced according to the specific circumstances.
