【摘要】：筆者作為一名政法干部,曾參加涪陵區(qū)肇事肇禍精神病人管控的調(diào)研,根據(jù)調(diào)研情況并結(jié)合在職法碩學(xué)習(xí)期間的理論知識(shí),完成本篇調(diào)研報(bào)告。本報(bào)告共分為“肇事肇禍精神病人行政管控調(diào)研概述”、“肇事肇禍精神病人行政管控存在的問題”、“肇事肇禍精神病人行政管控存在問題的原因分析”、“完善肇事肇禍精神病人行政管控的建議”四大部分。肇事肇禍精神病人行政管控的調(diào)研是基于涪陵區(qū)2013年1月發(fā)生的一起駭人聽聞的精神病人肇事肇禍案件引起的,筆者通過參加肇事肇禍精神病人管控調(diào)研,在梳理數(shù)據(jù)和案(事)例的基礎(chǔ)上,歸納整理了肇事肇禍精神病人在行政管控方面存在的六大問題,并試從法學(xué)角度找到問題產(chǎn)生的原因,結(jié)合涪陵區(qū)的經(jīng)驗(yàn)做法,提出完善肇事肇禍精神病人行政管控的建議。首先,通過調(diào)研,歸納了涪陵區(qū)對(duì)肇事肇禍精神病人進(jìn)行管控的行政部門以及他們的職責(zé),提出對(duì)肇事肇禍精神病人進(jìn)行行政管控的必要性以及筆者創(chuàng)新觀點(diǎn)的體現(xiàn)。其次,筆者從肇事肇禍精神病人管控的環(huán)節(jié)入手,指出涪陵區(qū)肇事肇禍精神病人行政管控存在的六大問題:排查不徹底;信息數(shù)據(jù)不準(zhǔn)確;管控主體不配合;送治困難;管控保障不到位;特殊肇事肇禍精神病人的管控?zé)o力。再次,筆者從法學(xué)角度分析了這些問題產(chǎn)生的原因,主要在于:一是制度方面存在缺陷。沒有一部適用于全國(guó)范圍的規(guī)范肇事肇禍精神病人管控的法律、行政法規(guī)或國(guó)務(wù)院部門規(guī)章。同時(shí),地方性法規(guī)、地方政府規(guī)章也沒有結(jié)合本地實(shí)際進(jìn)行細(xì)化;二是未建立爭(zhēng)議協(xié)調(diào)機(jī)制。在出現(xiàn)爭(zhēng)議時(shí),沒有外界協(xié)調(diào)機(jī)構(gòu)協(xié)調(diào)爭(zhēng)議;三是行政機(jī)關(guān)之間缺乏聯(lián)動(dòng)配合,引起管理失控、漏管;四是行政機(jī)關(guān)與肇事肇禍精神病人的監(jiān)護(hù)人博弈,造成送治困難;五是保障機(jī)制不健全,導(dǎo)致管控?zé)o力。最后,筆者提出完善肇事肇禍精神病人管控的建議:一是要建立健全相關(guān)制度,制定有效、實(shí)用的管控規(guī)范;二是建立爭(zhēng)議協(xié)調(diào)機(jī)制,包括組建機(jī)構(gòu)、明確協(xié)調(diào)形式、范圍和程序;三是加強(qiáng)行政機(jī)關(guān)聯(lián)動(dòng)管控,實(shí)現(xiàn)資源共享、優(yōu)勢(shì)互補(bǔ);四是完善管控保障機(jī)制。如財(cái)政、民政、人力社保、責(zé)任追究方面的保障機(jī)制;五是加強(qiáng)對(duì)特殊肇事肇禍精神病人的管控和保障。
[Abstract]:As a political and legal cadre, the author has taken part in the investigation on the management and control of the mental patients who caused the accident in Fuling District. According to the investigation situation and the theoretical knowledge during the on-the-job study, the author has completed this research report. This report is divided into four parts: "Overview of administrative management and control of mental patients caused by accident and accident", "problems existing in administrative control of mental patients caused by accident and accident", "causes analysis of administrative control problems of mental patients caused by accidents and accidents", The suggestion of perfecting the administrative control of mental patients caused by accident and accident is four parts. The investigation on administrative control of mental patients caused by accident and accident was caused by an appalling case of mental patients in Fuling District in January 2013. The author took part in the investigation on the management and control of mental patients who caused such accidents. On the basis of combing the data and the case (case), this paper sums up the six problems existing in the administrative management and control of the mental patients, and tries to find out the causes of the problems from the point of view of law, and combines the experience and practice of Fuling District. Put forward the suggestion of perfecting the administrative control of mental patients caused by accident and accident. First of all, through investigation, the administrative departments and their duties of controlling the mental patients caused by Zhaozhao in Fuling District are summarized, and the necessity of administrative control of the mental patients caused by the accident and the embodiment of the author's innovative views are put forward. Secondly, the author points out six problems in the administrative control of mental patients caused by Zhaozhao in Fuling District: the investigation is not thorough, the information data is not accurate, the main body of the control is not cooperating, and it is difficult to be sent to the hospital. Control and protection is not in place; special accident mental patient control is weak. Thirdly, the author analyzes the causes of these problems from the point of view of law. There are no national laws, administrative regulations or State Department regulations governing the management of mental patients. At the same time, local laws and regulations, local government regulations have not been combined with the actual local refinement; second, there is no dispute coordination mechanism. When there is a dispute, there is no external coordination organization to coordinate the dispute; third, the lack of coordination between the administrative organs, resulting in management out of control, missing management; fourth, the administrative organs and the guardian of the mental patient causing trouble, resulting in the difficulty of sending treatment; Fifth, the protection mechanism is not perfect, leading to weak control. Finally, the author puts forward some suggestions to improve the management and control of mental patients suffering from the accident. First, it is necessary to establish and improve the relevant system, to formulate effective and practical regulations for control and control; the other is to establish a dispute coordination mechanism, including the establishment of an organization and a clear form of coordination. Scope and procedure; third is to strengthen the management and control of administrative organs, to achieve the sharing of resources, complementary advantages; fourth, to improve the mechanism of control and protection. Such as finance, civil affairs, human social security, accountability for the protection mechanism; fifthly, to strengthen the control and protection of the mental patients suffering from special accidents.
