【摘要】：近年來(lái),隨著我國(guó)社會(huì)經(jīng)濟(jì)政治文化的快速發(fā)展以及城市化的進(jìn)程日益加快,房屋的征地和補(bǔ)償成為實(shí)現(xiàn)城鄉(xiāng)一體化、舊城換新城、建設(shè)新農(nóng)村的重中之重,伴隨著的房屋征地補(bǔ)償矛盾的不斷出現(xiàn),如何解決應(yīng)對(duì)征地拆遷所帶來(lái)的社會(huì)問(wèn)題以及法律問(wèn)題成為一個(gè)亟待解決的難題。然而,法律作為制度上的根本保障,在調(diào)節(jié)社會(huì)矛盾、解決利益沖突的問(wèn)題上起到了根本的作用,本文以研究行政拆遷訴訟實(shí)例為切入點(diǎn),進(jìn)而剖析因房屋征地補(bǔ)償帶來(lái)的問(wèn)題背后的深層次問(wèn)題。本文主要針對(duì)歷年來(lái)發(fā)表刊登的學(xué)位論文、學(xué)術(shù)期刊以及最高院發(fā)布的關(guān)于房屋征收與拆遷的指導(dǎo)性案例進(jìn)行研究,對(duì)《城市房屋拆遷管理?xiàng)l例》以及《國(guó)有土地上房屋征收與補(bǔ)償條例》在公布實(shí)施后對(duì)房屋征收與補(bǔ)償?shù)膶?shí)際影響進(jìn)行探究,歸納出在法律上,房屋征收補(bǔ)償制度體現(xiàn)的問(wèn)題以及弊端,本人認(rèn)為,弊端大致集中在以下四點(diǎn)：第一,房屋拆遷補(bǔ)償原則和標(biāo)準(zhǔn)模糊不確定。第二,房屋拆遷補(bǔ)償標(biāo)準(zhǔn)不能依據(jù)市場(chǎng)規(guī)律變化,具有一定的滯后性。第三,從程序上,行政拆遷裁決拆的公開性和公正性無(wú)法保證。最后,“司法強(qiáng)拆”制度仍有待完善。最后,針對(duì)本文所提出的問(wèn)題,本人在全面分析歷史、案例、法規(guī)以及其他作者的觀點(diǎn)后,結(jié)合社會(huì)實(shí)際提出四點(diǎn)意見：加強(qiáng)對(duì)我國(guó)房屋征收與補(bǔ)償?shù)牧⒎�、更加注重�?duì)私人權(quán)利的維護(hù)；將行政征收補(bǔ)償?shù)臉?biāo)準(zhǔn)市場(chǎng)化、使被拆遷人擁有更多補(bǔ)償方式的選擇權(quán)；轉(zhuǎn)變行政機(jī)關(guān)的執(zhí)法理念,致力于建設(shè)服務(wù)性政府；完善房屋征地拆遷的程序。這樣能夠從根本上保護(hù)被拆遷人的權(quán)利,創(chuàng)建規(guī)范和諧的制度環(huán)境。
[Abstract]:In recent years, with the rapid development of social economy, politics and culture in our country and the accelerating process of urbanization, land requisition and compensation of houses have become the most important task in realizing the integration of urban and rural areas, changing old cities for new towns, and building new rural areas. With the continuous emergence of the contradiction of compensation for land requisition, how to solve the social and legal problems caused by land requisition and demolition has become a difficult problem to be solved. However, as the fundamental guarantee of the system, law plays a fundamental role in regulating social contradictions and resolving conflicts of interest. Then analyze the deep problems behind the problems caused by the compensation for land requisition. This paper focuses on the studies of academic papers published over the years, academic journals and instructive cases of house expropriation and demolition published by the Supreme Court. This paper probes into the actual effects of the regulations on the Administration of Urban Housing demolition and relocation and the regulations on the Collection and compensation of Housing on State-owned Land after the promulgation and implementation of the regulations, and sums up the legal implications of the regulations on the collection and compensation of houses. In my opinion, the shortcomings of the system of house expropriation and compensation are mainly focused on the following four points: first, the principle and standard of compensation for house demolition are vague and uncertain. Second, housing demolition compensation standards can not be changed according to the market law, with a lag. Thirdly, from the procedure, the openness and fairness of the administrative demolition ruling cannot be guaranteed. Finally, the system of judicial demolition still needs to be improved. Finally, in view of the questions raised in this paper, after analyzing the history, cases, laws and regulations and other authors' views, I put forward four suggestions: strengthening the legislation on the collection and compensation of housing in our country. Pay more attention to the protection of private rights; make the standard of administrative levy and compensation market-oriented, so that the relocation people have more options of compensation, change the law enforcement concept of the administrative organs, and devote themselves to the construction of a service-oriented government; Perfect the procedure of house land requisition and removal. This can fundamentally protect the rights of the removed person and create a standardized and harmonious institutional environment.
