【摘要】：當(dāng)前我國面臨的環(huán)境保護(hù)形勢十分嚴(yán)峻,人民群眾要求嚴(yán)厲打擊破壞環(huán)境行為和改善環(huán)境質(zhì)量的呼聲很高。黨的十八大報告首次提出生態(tài)文明建設(shè),新《環(huán)境保護(hù)法》全篇貫徹黨中央關(guān)于推進(jìn)生態(tài)文明建設(shè)的一系列新部署新要求,它的出臺和將來實施為保護(hù)生態(tài)環(huán)境和防治環(huán)境污染注入了一劑強(qiáng)心針。 新《環(huán)境保護(hù)法》呈現(xiàn)眾多亮點,在眾多方面取得了突破和創(chuàng)新,掀開了我國環(huán)境保護(hù)法制建設(shè)的新篇章。對比原《環(huán)境保護(hù)法》,通過比較分析新修訂的《環(huán)境保護(hù)法》在立法目的、法律責(zé)任、基本制度等方面有重大突破和關(guān)鍵創(chuàng)新,為新時期生態(tài)文明建設(shè)提供了法律依據(jù)。 需要清楚的看到,新《環(huán)境保護(hù)法》仍然存在諸多不能盡如人意之處,應(yīng)用到環(huán)境保護(hù)實際工作中還面臨一些難題。一是新法許多規(guī)定難以具體操作；二是生態(tài)管理依然弱化,重污染防治輕生態(tài)保護(hù)格局沒有改變；三是沒有認(rèn)可環(huán)境權(quán)；四是機(jī)構(gòu)設(shè)置存在不合理。因此,新法實施還需要在理論上進(jìn)行研究探討的一個過程,唯有如此才能讓新法完全的真正的發(fā)揮作用。
[Abstract]:At present, the situation of environmental protection in our country is very severe, and the people are demanding to crack down severely on the behavior of destroying the environment and to improve the quality of the environment. The report of the 18th National Congress of the Party put forward for the first time the construction of ecological civilization, and the new "Environmental Protection Law" has fully implemented a series of new arrangements and new requirements of the Party Central Committee on promoting the construction of ecological civilization. Its introduction and future implementation for the protection of the ecological environment and environmental pollution injection of a strong needle. The new Environmental Protection Law presents many bright spots, and has made breakthroughs and innovations in many aspects, opening a new chapter in the construction of the legal system of environmental protection in China. Compared with the original "Environmental Protection Law", the newly revised "Environmental Protection Law" has great breakthrough and key innovation in legislative purpose, legal responsibility, basic system and so on, which provides the legal basis for the construction of ecological civilization in the new period. It is necessary to see clearly that there are still many problems in the application of the new Environmental Protection Law to the practical work of environmental protection. First, many provisions of the new law are difficult to operate; second, ecological management is still weakened, pollution prevention is not changed; third, environmental rights are not recognized; fourth, the establishment of institutions is unreasonable. Therefore, the implementation of the new law also needs a theoretical research and discussion process, only in this way, the new law can play a real role.
