【摘要】:PPP模式運(yùn)用于城市基礎(chǔ)設(shè)施建設(shè)中,實(shí)現(xiàn)了給付行政的現(xiàn)實(shí)需求。然而,由于政府在項(xiàng)目中享有行政優(yōu)益權(quán),在現(xiàn)有法律未對(duì)政府法律責(zé)任進(jìn)行具體規(guī)定的情況下,造成政府怠于承擔(dān)法律責(zé)任的現(xiàn)象屢見(jiàn)不鮮。作為PPP項(xiàng)目基礎(chǔ)的PPP協(xié)議具有混合性,即民事性與行政性。民事性體現(xiàn)在政府部門與社會(huì)資本是合作關(guān)系,雙方基于平等的法律地位進(jìn)行協(xié)商約定雙方的權(quán)利義務(wù)關(guān)系,因而政府部門存在承擔(dān)民事法律責(zé)任的可能性。行政性指的是政府是PPP項(xiàng)目的提供者、監(jiān)管者,政府部門及政府官員行政權(quán)力的不當(dāng)行使易導(dǎo)致政府部門怠于承擔(dān)誠(chéng)信責(zé)任、監(jiān)管責(zé)任、風(fēng)險(xiǎn)分擔(dān)責(zé)任,此時(shí)應(yīng)當(dāng)要求政府部門承擔(dān)行政法律責(zé)任。在研究政府法律責(zé)任的問(wèn)題上,本文思路如下:首先,分析PPP模式中應(yīng)當(dāng)要求政府承擔(dān)法律責(zé)任的法理依據(jù)及法律規(guī)定,對(duì)政府法律責(zé)任的構(gòu)成展開討論;其次,實(shí)踐中政府怠于承擔(dān)誠(chéng)信責(zé)任、監(jiān)管責(zé)任與風(fēng)險(xiǎn)分擔(dān)責(zé)任導(dǎo)致PPP項(xiàng)目失敗的例子很多,政府對(duì)此應(yīng)當(dāng)承擔(dān)法律責(zé)任。分析政府怠于承擔(dān)上述責(zé)任的原因并找出解決對(duì)策,包括完善PPP立法、確立政府行為的基本準(zhǔn)則、加強(qiáng)監(jiān)管機(jī)制等;最后,從糾紛解決機(jī)制角度討論應(yīng)當(dāng)如何追究政府的法律責(zé)任。對(duì)政府法律責(zé)任進(jìn)行劃分包括民事法律責(zé)任和行政法律責(zé)任。政府不同的法律責(zé)任應(yīng)當(dāng)有不同的糾紛解決途徑,根據(jù)政府行為的性質(zhì)、政府的法律地位等綜合判斷。適用協(xié)商、民事訴訟及仲裁途徑追究政府民事法律責(zé)任時(shí),應(yīng)當(dāng)注意到政府行政權(quán)力是否會(huì)在糾紛解決中造成不利影響。新《行政訴訟法》的出臺(tái)為解決PPP協(xié)議下政府的行政法律責(zé)任提供了法律依據(jù)。在具體討論了政府部門應(yīng)當(dāng)對(duì)社會(huì)資本應(yīng)當(dāng)承擔(dān)的法律責(zé)任前提下,本文分析了社會(huì)公眾在項(xiàng)目中受到損害時(shí)政府部門承擔(dān)法律責(zé)任的三種情況,為保護(hù)社會(huì)公眾的合法利益提出了自身見(jiàn)解!墩少(gòu)法》、國(guó)務(wù)院部門及地方政府出臺(tái)的一系列規(guī)范性法律文件如《PPP項(xiàng)目合同指南》等對(duì)于政府與非政府組織之間的法律關(guān)系作出了規(guī)定,而新行政訴訟法及司法解釋對(duì)適用行政訴訟解決政府行政法律關(guān)系提供了法律依據(jù),有效地限制了政府的行政權(quán)力、保護(hù)了相對(duì)人和其他利害關(guān)系人的合法利益。因此在PPP項(xiàng)目中發(fā)生政府怠于承擔(dān)法律責(zé)任的行為時(shí),根據(jù)政府主體的地位、法律關(guān)系的構(gòu)成、損害行為的性質(zhì)、法律責(zé)任的承擔(dān)情況來(lái)綜合判斷,提出適用的救濟(jì)機(jī)制,從而實(shí)現(xiàn)規(guī)范PPP模式下政府應(yīng)當(dāng)承擔(dān)法律責(zé)任的目的。
[Abstract]:The PPP model is applied to urban infrastructure construction, which realizes the realistic demand of the administration of payment. However, because the government has the right of administrative benefit in the project, it is common for the government to bear the legal responsibility without the specific provisions of the existing law. The PPP protocol, which is the foundation of PPP project, is mixed, that is, civil and administrative. The civil nature is reflected in the cooperative relationship between government departments and social capital. The two sides negotiate and agree on the relationship of rights and obligations based on equal legal status, so the government departments have the possibility to bear civil legal liability. Administration refers to the government is the provider of PPP projects, regulators, government departments and government officials of the improper exercise of administrative power is likely to lead to government departments to bear the integrity of responsibility, regulatory responsibility, risk sharing responsibility. At this time, government departments should be required to assume administrative legal responsibility. In studying the problem of government legal responsibility, this paper has the following ideas: firstly, it analyzes the legal basis and legal provisions of the PPP model which should require the government to bear legal responsibility, and then discusses the constitution of the government legal responsibility. In practice, there are many examples of the failure of the PPP project caused by the responsibility of supervision and risk sharing, for which the government should bear the legal responsibility. Analyze the reason why the government is lazy to assume the above responsibility and find out the countermeasures, including perfecting the PPP legislation, establishing the basic standard of government behavior, strengthening the supervision mechanism and so on. From the angle of dispute settlement mechanism, the author discusses how to investigate the legal responsibility of the government. The division of government legal liability includes civil legal liability and administrative legal liability. Different legal responsibilities of government should have different ways to resolve disputes, according to the nature of government behavior, the legal status of government and so on. When applying negotiation, civil action and arbitration to investigate the civil legal liability of the government, we should pay attention to whether the administrative power of the government will have a negative impact on the settlement of disputes. The introduction of the new Administrative Litigation Law provides a legal basis for solving the government's administrative legal liability under the PPP Agreement. On the premise of discussing the legal responsibility of the government department to the social capital, this paper analyzes the three kinds of cases of the government department bearing the legal responsibility when the public is damaged in the project. In order to protect the legitimate interests of the public, put forward their own views. "Government Procurement Law", the State Council departments and local governments issued a series of normative legal documents such as "PPP Project contract Guide" for the government and non-governmental organizations The legal relationship between The new administrative procedure law and judicial interpretation provide a legal basis for the application of administrative litigation to solve the administrative legal relationship between the government, effectively limit the administrative power of the government, and protect the legitimate interests of the counterpart and other interested parties. Therefore, when the behavior of the government in the PPP project is slack to bear the legal responsibility, according to the position of the government subject, the constitution of the legal relationship, the nature of the damage act, and the assumption of the legal liability, the author puts forward the applicable relief mechanism. In order to achieve the standard PPP model, the government should bear legal responsibility.
