論我國環(huán)境污染強制責(zé)任保險制度的構(gòu)建

【摘要】:隨著社會經(jīng)濟的不斷發(fā)展,我國的環(huán)境污染也愈發(fā)嚴(yán)重,損害賠償問題也越來越突出,部分發(fā)達(dá)國家通過引入責(zé)任保險制度來解決環(huán)境損害賠償糾紛,合理分散了風(fēng)險,充分保障受害人獲得全面而及時的賠償,在實踐中積極開展環(huán)境污染強制責(zé)任保險,并且形成了相對成熟的理論體系。我國在2008年年初通過發(fā)布《關(guān)于環(huán)境污染責(zé)任保險的指導(dǎo)意見》才正式啟動了環(huán)境責(zé)任保險的試點工作,環(huán)境責(zé)任保險得到初步的發(fā)展。但是,我國在法律規(guī)定中并沒有對環(huán)境責(zé)任保險的模式給予明確的規(guī)定,整個環(huán)境污染責(zé)任保險的發(fā)展缺少立法的支撐,所以筆者認(rèn)為應(yīng)該加強“強制性”的方式實施環(huán)境污染責(zé)任保險,完善立法體系及其環(huán)境污染強制責(zé)任保險的整體制度構(gòu)建。 本文主要分為四部分對我國環(huán)境污染強制責(zé)任保險制度的構(gòu)建進(jìn)行論述,第一部分主要是針對環(huán)境污染強制責(zé)任保險概念的界定,對其予以概念上的明晰,對環(huán)境強制責(zé)任保險的特征、功能以及法理經(jīng)濟理論基礎(chǔ)進(jìn)行必要的分析。第二部分主要是針對我國現(xiàn)行的環(huán)境污染責(zé)任保險試點狀況的不足進(jìn)行分析,而后就是對最新發(fā)布的《關(guān)于開展環(huán)境污染強制責(zé)任保險工作試點的指導(dǎo)意見》的解讀,來分析存在的問題和理清如何改進(jìn)的思路。第三部分主要針對分析借鑒國外一些國家實行環(huán)境污染強制責(zé)任保險的經(jīng)驗。第四部分從環(huán)境污染強制責(zé)任保險的具體制度設(shè)計出發(fā),在立法、保險合同內(nèi)容、監(jiān)管以及其他輔助制度的建立上等幾個方面來明確和完善整個環(huán)境污染強制責(zé)任保險
[Abstract]:With the continuous development of social economy, the environmental pollution in our country is becoming more and more serious, and the problem of compensation for damage is becoming more and more prominent. Some developed countries adopt the liability insurance system to solve the dispute of environmental damage compensation, which reasonably distributes the risk. Fully protect the victim to obtain comprehensive and timely compensation, in practice to actively carry out environmental pollution compulsory liability insurance, and formed a relatively mature theoretical system. At the beginning of 2008, China officially started the pilot work of environmental liability insurance by issuing the guidance opinion on environmental pollution liability insurance, and the environmental liability insurance got a preliminary development. However, the mode of environmental liability insurance has not been clearly stipulated in the legal provisions of our country, and the development of the whole liability insurance for environmental pollution lacks the support of legislation. Therefore, I think we should strengthen the "mandatory" way to implement environmental pollution liability insurance, improve the legislative system and the overall construction of environmental pollution compulsory liability insurance system. This paper is divided into four parts to discuss the construction of compulsory liability insurance system for environmental pollution in China. The first part is to define and clarify the concept of compulsory liability insurance for environmental pollution. This paper analyzes the characteristics, functions and the theoretical basis of environmental compulsory liability insurance. The second part is mainly to analyze the deficiency of the current environmental pollution liability insurance pilot in China, and then to interpret the newly released guidance on the pilot work of environmental pollution compulsory liability insurance. To analyze the existing problems and clarify how to improve the train of thought. The third part is mainly aimed at analyzing and drawing lessons from the experience of some foreign countries in implementing compulsory liability insurance for environmental pollution. The fourth part from the environment pollution compulsory liability insurance concrete system design, in the legislation, the insurance contract content, the supervision and other auxiliary system establishment and so on several aspects clearly and consummates the entire environment pollution compulsory liability insurance.
