【摘要】：行政復(fù)議的功能定位是行政復(fù)議制度的基礎(chǔ)理論問題,是整個(gè)制度運(yùn)行的基石和起點(diǎn)。在海峽兩岸,我國(guó)大陸現(xiàn)行行政復(fù)議制度的功能定位側(cè)重于行政機(jī)關(guān)的內(nèi)部層級(jí)監(jiān)督與自我糾錯(cuò),而臺(tái)灣地區(qū)訴愿制度則側(cè)重于行政相對(duì)人的權(quán)利保障與救濟(jì),不同的功能定位直接影響著具體制度建構(gòu)以及運(yùn)行實(shí)效。本文從功能定位的視角切入,考察兩岸行政復(fù)議制度的立法沿革和制度運(yùn)行現(xiàn)狀,從而對(duì)兩岸制度背后的基本理念和相關(guān)制度進(jìn)行比較研究,以加深對(duì)行政復(fù)議制度的理解,為大陸修改《行政復(fù)議法》提供相關(guān)的理論支撐。
[Abstract]:The function orientation of administrative reconsideration is the basic theoretical problem of administrative reconsideration system and the cornerstone and starting point of the whole system. On both sides of the Taiwan Strait, the functional orientation of the current administrative review system in mainland China focuses on the internal supervision and self-correction of administrative organs, while the appeal system in Taiwan focuses on the protection and relief of the rights of the administrative counterpart. Different functional positioning directly affects the specific system construction and operational effectiveness. From the perspective of function orientation, this paper investigates the legislative evolution and system operation of the administrative reconsideration system on both sides of the strait, so as to make a comparative study of the basic concepts and related systems behind the cross-strait system, in order to deepen the understanding of the administrative reconsideration system. For the mainland to amend the Administrative Review Law to provide relevant theoretical support.
