【摘要】：近年來(lái)，全國(guó)各地醫(yī)療事故、醫(yī)療訴訟、大量發(fā)生且預(yù)防效果并不理想。幾乎每天在電視報(bào)紙以及公民去醫(yī)院就診時(shí)都能看到患者及家屬因醫(yī)院救治過(guò)程中發(fā)生的傷害、死亡的醫(yī)療事故及案件，而由于我國(guó)目前民事法律及醫(yī)療事故歸責(zé)、賠償途徑渠道不暢等原因?qū)е碌挠舍t(yī)患沖突及由此演變的嚴(yán)重刑事案件更是不斷發(fā)生，繼上海新華醫(yī)院傷醫(yī)案、溫嶺殺醫(yī)案后，，僅今年的2月18日及2月19日黑龍江北滿特鋼醫(yī)院和河北易縣人民醫(yī)院就發(fā)生了兩起嚴(yán)重惡劣性質(zhì)殺醫(yī)案件，一名醫(yī)生被高中生殺害，一名醫(yī)生被割喉重傷。其中所暴露出的醫(yī)患糾紛以及醫(yī)療事故法律體制實(shí)施及運(yùn)作上不足，已經(jīng)引起了人們的高度關(guān)注。因此如何判斷醫(yī)療事故，如何站在患者及醫(yī)生角度，學(xué)習(xí)運(yùn)用民法原理，了解醫(yī)療事故相關(guān)的法律法規(guī)、醫(yī)保政策等方面來(lái)促進(jìn)醫(yī)療工作發(fā)展，有效避免或減少醫(yī)療事故發(fā)生，保護(hù)人民群眾最基本的人身安全合法權(quán)益，就顯得十分必要。 為此，筆者以一名普通的法律工作者經(jīng)歷，在本文寫(xiě)作中從對(duì)醫(yī)療事故的基本概念研究入手，結(jié)合我國(guó)現(xiàn)行醫(yī)療相關(guān)法律的規(guī)定和現(xiàn)實(shí)中司法實(shí)踐、社會(huì)現(xiàn)狀、和相關(guān)理論對(duì)醫(yī)療事故中的民事責(zé)任歸責(zé)和賠償原則進(jìn)行淺析。就其中幾個(gè)值得注意的問(wèn)題，進(jìn)行了重點(diǎn)討論。第一、關(guān)于鑒定費(fèi)、鑒定人出庭、舉證責(zé)任、歸責(zé)原則體系、賠償不合理等問(wèn)題；第二、歸納梳理了醫(yī)療事故頻發(fā)的原因，分析討論了相關(guān)學(xué)者觀點(diǎn)以及國(guó)外醫(yī)療事故處理制度的特點(diǎn)，以期正確把握我國(guó)醫(yī)療事故中的民事責(zé)任歸責(zé)和賠償原則；第三、在前人大量實(shí)踐經(jīng)驗(yàn)和觀點(diǎn)意見(jiàn)的基礎(chǔ)上提出自己的相關(guān)立法建議，即要合并、統(tǒng)一醫(yī)療事故或者醫(yī)療損害鑒定機(jī)構(gòu)，同時(shí)縮短訴訟期間并嚴(yán)格按照民訴法規(guī)定、我國(guó)程序法律要求進(jìn)行醫(yī)療事故案件的審理與處理、完善第三方調(diào)解制度的有效性與合法性，從立法上保障調(diào)解協(xié)議有效執(zhí)行；第四、通過(guò)立法制定《醫(yī)療事故法》與《醫(yī)療損害賠償法》，使醫(yī)療事故處理規(guī)則和賠償形成邏輯通順適用不矛盾的完整體系，加強(qiáng)公民守法意識(shí)與醫(yī)生法定職責(zé)的獎(jiǎng)懲，改善醫(yī)患關(guān)系，預(yù)防和減少醫(yī)療事故發(fā)生以及發(fā)生醫(yī)療事故后能迅速妥善處理。
[Abstract]:In recent years , the medical accidents , medical lawsuits , and the prevention of medical accidents in various parts of the country have taken place in a large amount and the prevention effect is not ideal .

Based on the basic concept of medical accidents , the author analyses the principle of liability and compensation for civil liability in medical accidents . First , on the basis of the basic concept of medical accidents , the author makes a brief analysis on the liability and compensation principle of civil liability in medical accidents .
Secondly , the causes of the frequent occurrence of medical accidents are summarized , the opinions of the relevant scholars and the characteristics of the foreign medical accident treatment system are discussed , so as to correctly grasp the liability and compensation principle of civil liability in medical accidents in China ;
Thirdly , the author puts forward his own relevant legislative suggestion on the basis of the great practical experiences and opinions of the former , that is to merge , unify the medical accident or medical damage appraisal institution , shorten the lawsuit period and strictly follow the civil procedure law , the procedure law of our country calls for the trial and treatment of medical accident cases , perfect the validity and legality of the third party mediation system , and guarantee the effective implementation of the mediation agreement from the legislation ;
Fourthly , through the legislative development of the Law on the Compensation of Medical Accident Law and the Law on Compensation for Compensation for Medical Damage , the rules of medical accident treatment and the formation logic of compensation are smoothly applied to the complete system of non - contradiction , to strengthen the reward and punishment of legal duties of doctors and doctors , to improve the relationship between doctors and patients , to prevent and reduce the occurrence of medical accidents and to handle promptly after the occurrence of medical accidents .
