行政法視角下我國公務員問責制度研究

【摘要】:近代意義上的公務員問責制在我國起步較晚,目前尚處于個案問責起步階段,相關法律制度還不夠完善,問責活動開展的過程中還存在很多問題,還需要作進一步的深入研究。本文從行政法的視角出發(fā),對公務員問責制的概念、要素、理論基礎進行介紹,分析了當前我國公務員問責制的現(xiàn)狀,并對制度中存在的一些問題,提出相應的完善對策。本文分為五個部分,文章的基本結構如下:第一部分概述了我國公務員問責制的基本概念,首先是公務員的概念與范圍,考慮研究旨趣所在,且為便于比較研究,本文僅就中央和地方各級行政機關中的公務員進行探討,對于其他公務員主體只能斟酌適用。其次是公務員問責制的概念,本文分析了問責制的字面含義及學者的不同觀點,提出來行政法視角下的公務員問責制的含義。第二部分分析了公務員問責制的構成要素,其構成要素包括問責制的主體、客體、范圍、程序、后果五個方面,以便更進一步了解公務員問責制。第三部分介紹了行政法視角下公務員問責制的理論基礎,主要包括法治理論、人民主權理論、權責一致理論,使得公務員問責制有理論支撐。第四部分分析了我國公務員問責制的成效,我國公務員問責制有國家和地方層面的法律支持,法律基礎不斷形成;在實踐中,我國公務員問責制的實施效果明顯。第五部分在上文的基礎之上指出了行政法視角下的我國公務員問責制存在的問題并在借鑒國外先進經驗的基礎之上提出來了相關的完善措施。
[Abstract]:In the modern sense, the accountability system of civil servants started late in our country, at present it is still in the initial stage of individual accountability, the relevant legal system is not perfect, there are still many problems in the process of carrying out accountability activities, which need to be further studied. From the perspective of administrative law, this paper introduces the concept, elements and theoretical basis of the accountability system of civil servants, analyzes the present situation of the accountability system of civil servants in our country, and puts forward some countermeasures to improve the system. This paper is divided into five parts. The basic structure of the article is as follows: the first part summarizes the basic concepts of the accountability system of civil servants in China, first of all, the concept and scope of civil servants, considering the purpose of the research, and to facilitate the comparative study. This paper discusses only the civil servants in the administrative organs at central and local levels, which can only be applied to other civil servants. Secondly, the concept of accountability system for civil servants. This paper analyzes the literal meaning of accountability system and different viewpoints of scholars, and puts forward the meaning of accountability system of civil servants from the perspective of administrative law. The second part analyzes the constituent elements of the accountability system of civil servants, which includes the subject, object, scope, procedure and consequence of the accountability system in order to better understand the accountability system of civil servants. The third part introduces the theoretical basis of the accountability system of civil servants from the perspective of administrative law, including the theory of rule of law, the theory of people's sovereignty, the theory of unity of power and responsibility, which makes the civil servant accountability system have theoretical support. The fourth part analyzes the effectiveness of the accountability system of civil servants in our country, which has the legal support of national and local level, and the legal basis has been formed constantly. In practice, the implementation effect of the accountability system of civil servants in our country is obvious. The fifth part points out the problems existing in the accountability system of civil servants under the perspective of administrative law on the basis of the above and puts forward the relevant improvement measures on the basis of drawing lessons from the advanced experience of foreign countries.
