【摘要】：中華民族五千年的燦爛文化是當(dāng)今世界唯一沒有中斷過的文明。中華文明之所以能在歷史長河中經(jīng)久不衰，并朝著中華民族偉大復(fù)興的宏偉目標(biāo)堅強有力地前進，很大程度是因為我們先進的農(nóng)耕文明。然而，在新的歷史時期，農(nóng)業(yè)生產(chǎn)水平已不符合當(dāng)今社會發(fā)展需求，不利于農(nóng)業(yè)的現(xiàn)代化建設(shè)。當(dāng)前雖然我國工業(yè)、科研、經(jīng)濟、國防等領(lǐng)域的建設(shè)已接近或達(dá)到現(xiàn)代化水平，但是農(nóng)業(yè)由于耕地不斷減少，水資源緊缺，災(zāi)害性氣候和思想束縛等因素的制約，造成國家整體經(jīng)濟發(fā)展滯后。因此，為實現(xiàn)中國現(xiàn)代化建設(shè)的目標(biāo)，如何有效整合并利用現(xiàn)有農(nóng)業(yè)資源顯得尤為緊迫。21世紀(jì)是信息時代，越是經(jīng)濟發(fā)達(dá)的地方，信息的重要性越突出，在農(nóng)業(yè)這個傳統(tǒng)行業(yè)也不例外。只有建立和完善農(nóng)業(yè)信息供給法律保障機制，才能促進農(nóng)村信息化建設(shè)的發(fā)展，實現(xiàn)農(nóng)業(yè)信息供給與需求的平衡。對此政府應(yīng)該在政策上給予支持，積極引導(dǎo)農(nóng)民樹立農(nóng)業(yè)信息主體意識，同時還應(yīng)該注重農(nóng)業(yè)信息的采集與供應(yīng)，加強新農(nóng)村的信息化建設(shè)。 本文通過分析我國農(nóng)業(yè)信息供給中存在的問題，結(jié)合國外先進經(jīng)驗，從農(nóng)業(yè)信息供給主體制度、農(nóng)業(yè)信息金融制度、保險制度、財政制度等多個方面進行分析和考量，建立健全我國的農(nóng)業(yè)信息供給法律保障機制。文章第一部分對農(nóng)業(yè)信息供給法律保障機制進行了概述。主要包括：農(nóng)業(yè)信息供給法律保障機制的基本涵義與意義，農(nóng)業(yè)信息與公共產(chǎn)品的關(guān)系，農(nóng)業(yè)信息供給法律保障的主體、客體及內(nèi)容，農(nóng)業(yè)信息供給法律保障機制的特征。第二部分簡要分析我國農(nóng)業(yè)信息供給法律保障機制的現(xiàn)狀及存在的問題。主要介紹：現(xiàn)行農(nóng)業(yè)信息供給的法律法規(guī)，，農(nóng)業(yè)信息供給的現(xiàn)實狀況以及目前我國農(nóng)業(yè)信息供給法律保障存在的問題。第三部分介紹美、日、韓三國的農(nóng)業(yè)信息供給法律保障實踐，試圖借鑒國外實踐經(jīng)驗來完善我國農(nóng)業(yè)信息供給法律保障機制。其中比較值得我國借鑒的經(jīng)驗主要包括：制定農(nóng)業(yè)信息供給法律，注重立法對農(nóng)業(yè)信息供給的保障；注重規(guī)定明確的主體權(quán)利義務(wù)，規(guī)范農(nóng)業(yè)信息供給主體的行為；注重制定完善的農(nóng)業(yè)協(xié)會制度，為農(nóng)民提供農(nóng)業(yè)信息咨詢服務(wù)；注重財政對農(nóng)業(yè)信息供給的支持，保障農(nóng)業(yè)生產(chǎn)。第四部分在前三部分的基礎(chǔ)之上，通過綜合分析提出解決農(nóng)業(yè)信息供給法律機制有關(guān)問題的具體途徑。主要包括：構(gòu)建農(nóng)業(yè)信息供給法律保障機制的主體制度，完善農(nóng)業(yè)信息供給法律保障的保險制度、金融激勵制度、財政支持制度、基礎(chǔ)設(shè)施制度以及教育制度。
[Abstract]:The splendid culture of the Chinese nation for five thousand years is the only civilization in the world that has not been interrupted. The reason why Chinese civilization can survive in the long history and advance strongly and forcefully towards the grand goal of the great rejuvenation of the Chinese nation is to a great extent due to our advanced agricultural civilization. However, in the new historical period, the level of agricultural production does not meet the needs of social development and is not conducive to the modernization of agriculture. Although the construction of industry, scientific research, economy, national defense and other fields in our country has reached or reached the level of modernization at present, agriculture is restricted by such factors as decreasing cultivated land, shortage of water resources, disastrous climate and ideological constraints, etc. As a result, the country's overall economic development lags behind. Therefore, in order to realize the goal of China's modernization, how to effectively integrate and utilize the existing agricultural resources is particularly urgent. The 21st century is the information age. The more developed the economy, the more important the information is. In agriculture, the traditional industry is no exception. Only by establishing and perfecting the legal guarantee mechanism of agricultural information supply can we promote the development of rural information construction and realize the balance between supply and demand of agricultural information. Therefore, the government should support the policy, actively guide farmers to set up the consciousness of agricultural information subject, at the same time, they should pay attention to the collection and supply of agricultural information, and strengthen the information construction of the new countryside. By analyzing the problems existing in the supply of agricultural information in China and combining the advanced experience of foreign countries, this paper analyzes and considers the main body system of agricultural information supply, the agricultural information finance system, the insurance system, the financial system, and so on. Establish and perfect the legal guarantee mechanism of agricultural information supply in our country. The first part of the article summarizes the legal guarantee mechanism of agricultural information supply. It mainly includes: the basic meaning and significance of the legal safeguard mechanism of agricultural information supply, the relationship between agricultural information and public goods, the subject, object and content of the legal guarantee of agricultural information supply, and the characteristics of the legal safeguard mechanism of agricultural information supply. The second part briefly analyzes the current situation and existing problems of the legal guarantee mechanism of agricultural information supply in China. This paper mainly introduces the current laws and regulations of agricultural information supply, the present situation of agricultural information supply and the problems existing in the legal guarantee of agricultural information supply in our country. The third part introduces the legal guarantee practice of agricultural information supply in America, Japan and Korea, and tries to perfect the legal safeguard mechanism of agricultural information supply in our country. The experience that our country should draw lessons from mainly includes: making agricultural information supply law, paying attention to the guarantee of agricultural information supply by legislation, paying attention to defining clear subject's rights and obligations, standardizing the behavior of agricultural information supply main body; Attention should be paid to the establishment of a perfect agricultural association system and the provision of agricultural information consulting services to farmers, and to the support of finance for the supply of agricultural information to ensure agricultural production. On the basis of the first three parts, the fourth part puts forward the specific ways to solve the problems related to the legal mechanism of agricultural information supply through comprehensive analysis. It mainly includes: constructing the main body system of the legal guarantee mechanism of agricultural information supply, perfecting the insurance system of the legal guarantee of agricultural information supply, financial incentive system, financial support system, infrastructure system and education system.
