【摘要】：軍品協(xié)作中知識產(chǎn)權(quán)被侵犯可以分為無心侵犯、跟蹤模仿和強(qiáng)勢獲取三種類型。知識產(chǎn)權(quán)維權(quán)尊權(quán)意識不強(qiáng),保護(hù)環(huán)境有待完善,國防知識產(chǎn)權(quán)保護(hù)調(diào)查取證難,維權(quán)救濟(jì)的有效途徑缺失,裝備質(zhì)量管理法規(guī)部分條款不合理、軟件定價(jià)未充分體現(xiàn)創(chuàng)新價(jià)值是軍品協(xié)作中知識產(chǎn)權(quán)被侵犯的主要原因。為加強(qiáng)軍品協(xié)作中的知識產(chǎn)權(quán)保護(hù),應(yīng)提高相關(guān)人員護(hù)權(quán)維權(quán)和尊權(quán)意識,營造良好的知識產(chǎn)權(quán)保護(hù)環(huán)境,健全國防知識產(chǎn)權(quán)保護(hù)機(jī)制,構(gòu)建科學(xué)合理可操作的維權(quán)細(xì)則和程序,改革完善現(xiàn)行裝備質(zhì)量管理法規(guī),在裝備定價(jià)中充分考慮軟件創(chuàng)新價(jià)值,強(qiáng)化軟件知識產(chǎn)權(quán)保護(hù)。
[Abstract]:The infringement of intellectual property rights in military cooperation can be divided into three types: inadvertent infringement, tracking imitation and strong acquisition. The consciousness of respecting the rights of intellectual property rights is not strong, the protection environment needs to be improved, the investigation of national defense intellectual property rights protection is difficult to obtain evidence, the effective ways of protecting rights relief are missing, and some provisions of equipment quality management laws and regulations are unreasonable. The innovative value of software pricing is the main reason for the infringement of intellectual property rights in military cooperation. In order to strengthen the protection of intellectual property rights in military cooperation, we should raise the awareness of protecting the rights of relevant personnel, create a good environment for the protection of intellectual property rights, and improve the protection mechanism of intellectual property rights of national defense. It is necessary to construct scientific and reasonable rules and procedures for safeguarding rights, to reform and perfect the current regulations of equipment quality management, to fully consider the value of software innovation in equipment pricing and to strengthen the protection of software intellectual property rights.
