【摘要】：訴訟作為一種問(wèn)責(zé)街頭官僚不當(dāng)執(zhí)法行為的監(jiān)督方式是有效的,但這種監(jiān)督方式受到諸多制約。行政相對(duì)人自身的法律意識(shí)和法律能力直接關(guān)系到能否掌握街頭官僚的執(zhí)法不當(dāng)行為的信息,這是對(duì)街頭官僚進(jìn)行問(wèn)責(zé)的關(guān)鍵。行政機(jī)關(guān)積極進(jìn)行撤訴動(dòng)員則是由于官僚體制內(nèi)部的激勵(lì)扭曲,現(xiàn)有的績(jī)效考核制度不僅沒(méi)有激勵(lì)行政機(jī)關(guān)在敗訴后改變自身行為,反而促使行政機(jī)關(guān)努力避免敗訴,績(jī)效考核指標(biāo)設(shè)計(jì)及績(jī)效考核的強(qiáng)激勵(lì)是產(chǎn)生激勵(lì)扭曲的根源。
[Abstract]:Litigation is an effective way to supervise the improper enforcement of law by street bureaucrats, but it is restricted by many restrictions. The administrative counterpart's own legal consciousness and legal ability are directly related to the ability to grasp the information of the street bureaucrats' improper law enforcement, which is the key to the accountability of the street bureaucrats. It is because of the internal incentive distortion in the bureaucratic system that the current performance appraisal system not only does not encourage the administrative organs to change their own behavior after losing the lawsuit, but also urges the administrative organs to try hard to avoid losing the lawsuit. The design of performance appraisal index and the strong incentive of performance appraisal are the source of incentive distortion.
