【摘要】：生態(tài)修復(fù)性司法的提出,作為對傳統(tǒng)司法模式未考量生態(tài)損害亟待修復(fù)的矯正,能夠?qū)崿F(xiàn)讓污染者受到懲罰、受損者獲得賠償、生態(tài)損害得以修復(fù)之三重目標(biāo),因而對預(yù)防與修復(fù)生態(tài)損害有著極其重要的積極意義,是我國當(dāng)下解決生態(tài)損害問題的最佳路徑。從現(xiàn)行的法律法規(guī)、國家政策等基礎(chǔ)規(guī)范出發(fā),一些省市加入到了生態(tài)修復(fù)性司法的地方實(shí)踐之中,取得了良好的實(shí)效。走向從中國實(shí)踐出發(fā)的生態(tài)修復(fù)性司法,亟待完善基礎(chǔ)規(guī)范與破解實(shí)踐困境來予以回應(yīng),確保受損害生態(tài)最大限度地回復(fù)到良好狀態(tài),進(jìn)而為生態(tài)文明建設(shè)創(chuàng)造出良好的司法環(huán)境。
[Abstract]:The proposal of ecological repair justice, as a correction to the traditional judicial model which does not consider the ecological damage urgently to be repaired, can achieve the triple goal of making polluters punished, the injured getting compensation, and the ecological damage being repaired. Therefore, it is of great significance to prevent and repair ecological damage, which is the best way to solve the problem of ecological damage in China. Based on the existing laws and regulations, national policies and other basic norms, some provinces and cities have joined the local practice of ecological restorative justice, and achieved good results. It is urgent to improve the basic norms and solve the practical dilemma to respond to the trend of ecological restorative justice, which is based on the practice of China, to ensure that the damaged ecology can be restored to a good state to the maximum extent. And create a good judicial environment for the construction of ecological civilization.
