【摘要】：目前,我國農(nóng)地的承包權(quán)在家庭內(nèi)部不允許繼承,法律上采取了"整體堵死、留有缺口"的態(tài)度,不僅邏輯混亂,而且嚴(yán)重滯后于現(xiàn)實(shí),造成了實(shí)際上的產(chǎn)權(quán)不清,對(duì)我國實(shí)現(xiàn)農(nóng)業(yè)現(xiàn)代化十分不利,因此,實(shí)行農(nóng)地單嗣繼承制勢(shì)在必行。農(nóng)地單嗣繼承制的客體是農(nóng)地的經(jīng)濟(jì)所有權(quán),必要性在于阻抑農(nóng)地細(xì)碎化,滿足土地一定程度規(guī)模經(jīng)營的需要;可行性在于我國城鎮(zhèn)化的速度大于人口自然增長速度,非農(nóng)收入高于農(nóng)業(yè)收入等現(xiàn)實(shí)條件。農(nóng)地單嗣繼承制的實(shí)行為農(nóng)戶家庭規(guī)模經(jīng)營提供了必要的制度環(huán)境,通過一定程度的規(guī)模經(jīng)營,可以有效地提高農(nóng)產(chǎn)品的市場(chǎng)競(jìng)爭(zhēng)力,縮小剪刀差,使農(nóng)業(yè)逐漸擺脫柔弱的頹勢(shì)。
[Abstract]:At present, the contract right of farmland in our country is not allowed to inherit in the family, and the law adopts the attitude of "blocking the death as a whole and leaving a gap", which is not only logical confusion, but also lags behind the reality seriously, resulting in the unclear property right in practice. Agricultural modernization is very disadvantageous to our country, therefore, it is imperative to carry out the single-issue inheritance system of agricultural land. The object of single issue inheritance system of farmland is the economic ownership of agricultural land, which is necessary to restrain the fragmentation of farmland and to meet the needs of land management on a certain scale, and the feasibility lies in the fact that the speed of urbanization is faster than the natural growth rate of population in our country. Non-agricultural income is higher than agricultural income and other realistic conditions. The implementation of the single issue inheritance system of agricultural land provides the necessary institutional environment for the scale management of the peasant households. Through a certain degree of scale management, the market competitiveness of agricultural products can be effectively improved, and the scissors difference can be reduced. Gradually shake off the weakness of agriculture.
