【摘要】：政府信息公開制度,有效地保障了公眾的知情權(quán),有利于公民、法人和其他組織實(shí)現(xiàn)對行政權(quán)力的監(jiān)督以及有序、有效地參與一定公共事務(wù)的管理。政府信息依申請公開進(jìn)一步滿足了公眾因自身生產(chǎn)、生活、科研等特殊需要和獲取相關(guān)政府信息的要求,實(shí)踐中,部分申請人濫用政府信息公開申請權(quán),違背了立法目的。如何在保障公民對政府信息知情權(quán)的同時又有效規(guī)制個別人濫用政府信息公開制度,已成為亟待解決的問題。
[Abstract]:The open system of government information effectively protects the public's right to know and is beneficial for citizens, legal persons and other organizations to supervise the administrative power and participate in the management of certain public affairs in an orderly and orderly manner. The disclosure of government information in accordance with the application further meets the requirements of the public for their own special needs such as production, life, scientific research, and obtaining relevant government information. In practice, some applicants abuse the right to open the application for government information, which is contrary to the legislative purpose. How to protect citizens' right to know about government information while effectively regulating individual abuse of government information disclosure system has become an urgent problem to be solved.
