【摘要】：我國兒童福利正處于補缺型兒童福利制度向適度普惠型兒童福利制度轉(zhuǎn)型的初期,在此期間,我國需要運用法律來保障兒童的福利,讓兒童的權(quán)利得到保護,讓全體兒童的合法權(quán)益不受到侵犯,使得兒童能夠更健康快樂地成長。兒童福利法律制度是關(guān)于兒童福利的法律規(guī)范的總稱,是為了確保兒童權(quán)利的實現(xiàn),利用法律法規(guī)在兒童權(quán)利的確認(rèn)與保護的基礎(chǔ)上,增加兒童福祉的一系列制度。經(jīng)過對我國的兒童福利法律制度的現(xiàn)狀分析,我國目前存在兒童福利立法層次偏低、兒童福利法律制度零散,缺少統(tǒng)一法律規(guī)范,兒童福利法律法規(guī)缺少可操作性等問題。本文就此提出相關(guān)建議:在兒童社會福利的法律制度上,樹立適度普惠型兒童福利理念,加快制定一部《兒童福利法》,健全我國具體兒童福利法律制度,全面保障兒童權(quán)益,使兒童享受相應(yīng)的福利待遇,保證我國全體兒童的各方面合法權(quán)益不受侵犯,使得全體兒童都擁有快樂的童年。
[Abstract]:China's child welfare is in the early stage of the transition from a complementary child welfare system to a moderately inclusive child welfare system. During this period, our country needs to use the law to safeguard the welfare of children and protect their rights. So that all children's legitimate rights and interests are not violated, so that children can grow up healthier and happier. The legal system of child welfare is the general name of the legal norms on the welfare of children. It is to ensure the realization of children's rights and to use laws and regulations to increase the well-being of children on the basis of the recognition and protection of children's rights. Through the analysis of the current situation of the child welfare legal system in our country, there are some problems in our country, such as the low level of the child welfare legislation, the scattered legal system of the child welfare, the lack of unified laws and regulations, the lack of maneuverability of the laws and regulations of the child welfare, etc. In this paper, some suggestions are put forward: in the legal system of children's social welfare, we should establish the concept of moderately inclusive child welfare, speed up the formulation of a Child Welfare Law, perfect the specific legal system of children's welfare in our country, and protect children's rights and interests in an all-round way. To make children enjoy the corresponding welfare treatment, to ensure that all the legitimate rights and interests of all children in our country are not infringed, so that all children have a happy childhood.
