【摘要】:開展基層公務(wù)員轉(zhuǎn)任工作,有利于調(diào)動基層公務(wù)員的工作積極性,從而激發(fā)組織活力;有利于培養(yǎng)后備干部,完善干部隊伍梯隊建設(shè);有利于合理配置人力資源,促進(jìn)相互交流;有利于促進(jìn)反腐倡廉建設(shè),真正保護(hù)干部;有利于解決基層公務(wù)員的實際困難,篤行人本理念?傊,該項工作符合全面深化改革的總體方向,符合行政體制改革的實際需要,具有“一箭多雕”的實際功效。 國內(nèi)外多名學(xué)者分別從經(jīng)濟(jì)學(xué)、管理學(xué)、心理學(xué)、法學(xué)等不同角度對公務(wù)員轉(zhuǎn)任問題進(jìn)行了研究,形成了諸多見解獨到的理論成果,但這些研究仍然存在針對性不強、體系不夠完整等方面的缺憾,因此,有必要對該課題繼續(xù)深挖。 筆者首先總結(jié)了美國、日本、法國、德國、韓國、西班牙等發(fā)達(dá)國家在公務(wù)員交流、轉(zhuǎn)任問題上的制度安排,并在此過程中,夾敘夾議,指出了值得我國學(xué)習(xí)借鑒的經(jīng)驗做法。隨后,總結(jié)回顧了我國近年來從中央到地方,各地各部門對基層公務(wù)員轉(zhuǎn)任的法治創(chuàng)新和實踐探索。 通過對比國外經(jīng)驗和國內(nèi)實踐,,筆者發(fā)現(xiàn),我國基層公務(wù)員轉(zhuǎn)任仍然存在許多問題,主要表現(xiàn)在三大層面:公務(wù)員個人對轉(zhuǎn)任心存顧慮,轉(zhuǎn)任趨利性明顯;基層公務(wù)員中轉(zhuǎn)任缺乏完善的法律體系;組織人事部門、紀(jì)檢監(jiān)察部門等有關(guān)部門在事前規(guī)劃、事中協(xié)調(diào)、事后評價、全程監(jiān)督等實施過程中嚴(yán)重缺位。 通過對問題的梳理、分析,筆者提出,從影響基層公務(wù)員轉(zhuǎn)任的三個層面入手,分析各自的癥結(jié)所在,進(jìn)而提出相應(yīng)對策,最終實現(xiàn)基層公務(wù)員轉(zhuǎn)任的法制化建構(gòu)。在此過程中,筆者著重強調(diào)要加快基層公務(wù)員轉(zhuǎn)任的專門立法,并詳細(xì)分析了立法中應(yīng)當(dāng)體現(xiàn)的轉(zhuǎn)任原則、立法重點以及立法的前期準(zhǔn)備。 雖然本文只是對我國基層公務(wù)員轉(zhuǎn)任法制化建構(gòu)的初步探討,不免存有諸多紕漏之處,但仍然希望能拋磚引玉,并對今后的理論研究和實踐進(jìn)程有所裨益。
[Abstract]:The transfer of civil servants at the grass-roots level is conducive to mobilizing the enthusiasm of civil servants at the grass-roots level, thus stimulating the vitality of the organization, fostering reserve cadres, perfecting the construction of echelons of cadres, and rationally allocating human resources. To promote mutual exchange, to promote anti-corruption construction, to truly protect cadres, to solve the practical difficulties of grass-roots civil servants, and to carry out the people-oriented concept. In a word, this work accords with the overall direction of deepening the reform in an all-round way, meets the actual needs of the reform of the administrative system, and has the practical effect of "one arrow and more carving". Many scholars at home and abroad have studied the transfer of civil servants from different angles, such as economics, management, psychology, law and so on. The system is not complete and so on, therefore, it is necessary to continue to dig deep into the subject. Firstly, the author summarizes the system arrangement of the exchange and transfer of civil servants in the developed countries, such as the United States, Japan, France, Germany, South Korea, Spain and so on. Then, the author summarizes and reviews the innovation and practice of the rule of law from central government to local government in recent years. By comparing the experience of foreign countries and the domestic practice, the author finds that there are still many problems in the transfer of civil servants at the grass-roots level in our country, mainly in three aspects: the individual of civil servants is worried about the transfer, and the transfer tends to profit obviously; The transfer of grass-roots civil servants lacks a perfect legal system; organizing personnel departments, discipline inspection and supervision departments and other relevant departments in the prior planning, coordination in the matter, post-evaluation, supervision and other implementation of the process of serious absence. Through combing and analyzing the problems, the author puts forward that starting with the three levels that affect the transfer of civil servants at the grass-roots level, the author analyzes the crux of their respective problems, and then puts forward the corresponding countermeasures, and finally realizes the legal construction of the transfer of civil servants at the grass-roots level. In this process, the author emphasizes the special legislation to speed up the transfer of civil servants at the grass-roots level, and analyzes in detail the principles of transfer, the emphases of legislation and the preliminary preparation of legislation. Although this paper is only a preliminary discussion on the construction of the legal system of the transfer of civil servants at the grass-roots level in China, there are many flaws, but we still hope that it will be helpful to the theoretical research and practice process in the future.
